A Study On The Legislation For The Farmers’ Minimal Livelihood Guarantee System Of China

As we all know, the problem of "agriculture, countryside and farmers" is important, andsolving this problem can contribute to the harmony and stability of our society. The problemof "farmers"is the core, and safeguarding farmers’ interests will contribute to the developmentof agriculture and the rural stability. The establishment of the farmers’ minimal livelihoodguarantee system is one of the best ways to safeguard the rights and interests of their lives.Although farmers’ minimal livelihood security work is spread across the country, but theexisting legislation can’t provide effective legal protection for the majority of farmers’s rightof minimal livelihood security. To properly solve this problem, set up social security systemcovering urban and rural areas, and protect the living rights and interests of masses of farmers,we must improve the legislation for the farmers’ minimal livelihood guarantee system in ourcountry.On the basis of analyzing the basic theory of the legislation for the farmers’ minimallivelihood guarantee system. This paper includes three parts. The first part is the introductionto the status quo and existing problems of the legislation for the farmers’ minimal livelihoodguarantee system in China, including the status quo of the legal system and seven majorissues. Based on the legislation for the farmers’ minimal livelihood guarantee system abroad,the second part discusses the overview of the legislation for the farmers’ minimal livelihoodguarantee system in countries represented by India, Brazil and Japan, and sums up referencefor us. The last part of the paper are the most important part,based on the summaries of thepresent situation and existing problems of our legislation for the farmers’ minimal livelihoodguarantee system, and on the basis of foreign advanced experience, we can find somecountermeasures to perfect our legislation for the farmers’ minimal livelihood guaranteesystem.
