Study On The Defect And Improvement On Agreement On Subsidies And Countervailing Measures

The Agreement on Subsidies and Countervailing Measures(ASCM) plays an important role in regulating and adjusting the subsidy problem. However,the WTO is a dynamic system. Now,with the development of international trade,many provisions in the agreement need to be clarified and improved.Unfortunately, because of the interests of all parties are unable to coordinate,the improvement of the SCM also ground to a halt. Therefore,this paper analyses the problems in the practice through specific analysis of SCM terms.This paper selects some focus problems of SCM, makes a detailed analysis of their causes and influence, and puts forward some improvement measures.The aim of this paper is to make the SCM more reasonable and perfect with the amended proposal of the parties in Doha round. The article is divided into four parts:The first part is an overview of the development of the SCM.This chapter briefly introduces the development process of the formation of the SCM agreement. from the Havana charter was mentioned for the first time to the Uruguay round. At the same time, the information of Doha round is introduced.The second part is about the analysis of the presence of defects in the SCM agreement. This chapter analyzes some focus problems and points out the existing problems of SCM.The third part is the suggestions for improvement of SCM agreement.WTO members put forward a lot of perfect proposal in the Doha round.They have different opinions for many defects.So this chapter elaborates the views and suggestions of WTO members on how to improve the SCM agreement.The last part is about the influence on China and the countermeasures of China.In recent years, the number of anti-subsidy cases filed against china increased.And mainly proposals puts forward by developed countries will cause adverse effect on China.Therefore, this chapter analyzes the influence of these unfavorable proposal for Chinese, and the countermeasures China should taken.The purpose of the analysis is for promoting the development of international trade and also for maintenance and implementation of China’s trade interests.
