Study On The Budget Hearing Legal System In China

Budget Hearing is an important way for the public to participate in budget operation. It isalso an effective means to improve the democracy and scientificity of budget. However, thereare still problems remain in practice, such as lags in legal protection, insufficiency of hearingprocess, and the lack of constraint mechanism and incentive mechanism. These problemsseriously restrict the development and function of Budget Hearing. This paper aims toconstruct the Budget Hearing legal system with clarifying the basic problems. It will alsosummarize and analyze the implementation situation of our recent Budget Hearing, and learnfrom foreign experience.This paper includes4main parts after the introduction part, about27000words.Part1is a summary of Budget Hearing. This part defines the basic concepts of BudgetHearing. It also states the characteristics, theoretical basis and realistic significance of BudgetHearing.Part2introduces the practice situations around China. This part includes severalrepresentative cases. These cases pinot out the defects such as the loss of legal basis, theunclearness of application range and stage, the insufficiency of hearing process, and the lackof response system and responsibility system.Part3introduces the Budget Hearing in foreign countries. Firstly, it makes a briefintroduction to Budget Hearing in foreign countries and summarizes the favorable experienceafter analyzing the situation of Budget Hearing in the United States and Japan.Part4claims that the Budget Hearing legal system should be established in China. Firstly,it put forwards construction should be combined with actual conditions in our country as awhole and then lists the detailed measures within the principle, including revising the relatedlaw, straightening out the detained procedures, improving supporting mechanisms andestablishing the constraint and incentive system.
