Collaborative Governance Of Community Corrections

At present, our country is in the economic and social transformation period, the rapid development of science and technology, social change dramatically accelerating and deepening globalization era, increasingly complex and varied social life. The traditional custodial sentence because of the high cost of execution, cross-infection within the prison recidivism rate, after the release of the crime object suited to life, more suited to the penalties development. Hence, China has actively learn from the world community corrections philosophy and shadowing those advanced countries, a pilot program since 2003, in 2009 the full trial in the country, and in 2011 established a community correction system in the "Criminal Law Amendment(eight)", the Community Corrections to this community in an open environment offender non-custodial sentence execution methods have become more common.Plenary Session of the Party’s Sixteenth proposed, "strengthen social construction and management, and promote innovative social management system requirements" clearly stressed the need to build a "party leadership, government responsibility, public participation, social collaboration," a new pattern of social management, to promote community correction pointed out the direction, we just want justice community corrections as an innovative practice to look at, and make community corrections as refraction social mainstream values and social governance ideas of social management system to multi-angle thinking. To enhance the effectiveness of community correction, we must break the traditional from top-down, fragmented, single management system vertical management through positive interaction between government and society, to achieve the government, society and citizens cohabitation, both to strengthen the government in correcting unified decision-making process and the rights of decision, but also to ensure that all levels of local government departments to carry out relevant organizations and decentralized operations, while also actively encourage attract business, NGO, international organizations and individual citizens diverse social forces such as collaborative participation in various social factors play integration and functional advantages of education in helping to maximize the good supervision, maintenance, and promote the public interest, promote social orderly, sustainable and harmonious development.From the perspective of cooperative governance, in order to explore the practice of Minhang District Community Corrections,for instance, to build collaborative governance of community correction optimization proposal. Overall, it can be divided into six parts. First, one introduction of the article research background, significance, literature review, research ideas and methods of presentation; Second, community corrections is to introduce collaborative governance connotation and characteristics, the full text laid theoretical basis; Third is analysis the United States, Japan, Britain’s community corrections collaborative governance practices, provide experience for China; Fourth, our analysis of the current status quo and the plight of community corrections; Fifth, is based on the theory, for example in Minhang District, Shanghai analysis of community correction values and the promotion of cooperative governance deficiencies in practice; last but not least,updated from the concept of cohesion ideological consensus Community Corrections collaborative governance mechanisms; system design, to improve the legal framework for community corrections collaborative governance mechanisms; innovative approaches to integrate collaborative community corrections three levels of all resources and other governance mechanisms proposed to optimize collaborative governance of community correction suggestions. Since the analytical framework constructed in this paper has some limitations, and the limitations of the empirical case itself, and the limited ability level of itself, needs further demonstration and practice deepened.
