A Study On Adr Mechanism For Medical Dispute Resolution

China is under a special historical period for social and medical system transition. The growth of medical disputes and the social problems arising from their treatments have reflected the extraordinarily strained relation between physicians and patients. Existing resolution channels for medical disputes are far from enough to satisfy the demands of social citizens. To explore and optimize existing resolution channels has become an urgent wish and demand in social and academic circles. K, a county-level city of Guangdong Province, is located in the developed region of Pearl River Delta. Frequent medical disputes and its increasing trend conflict with the current resolution mechanism of medical disputes, which affects physician-patient harmony and social stability. Therefore, to explore a better resolution channel for medical disputes is particularly urgent.Sufficient material collection, investigation and research are conducted for current status of existing medical disputes, ineffective resolution mechanism, existing problems and their causes through such approaches as material analysis, questionnaire and focus interview. Relevant data is induced and analyzed by summarizing and comparing relevant data. By referring to successful experience of medical disputes by ADR in other countries and regions such as USA, Japan, Germany, South Korea and Taiwan as well as useful exploration for medical disputes which are solved through alternative dispute resolution of the third party introduced in Beijing, Nanjing, Tianjin, Shanghai and Shenzhen, it is proposed that K City can establish the intermediation mechanism for medical disputes involved by the third party. Medical liability insurance system can be promoted effectively, and corresponding resolution channels such as arbitration mechanism can be established so as to solve medical disputes in a quick, effective and low-cost manner, set up and maintain good physician-patient relations, maintain social stability and realize innovation of social management.This paper is composed of six chapters: Chapter 1 Introduction. In Chapter 2, the concept and basic theory of medical disputes and ADR mechanism are summarized. In Chapter 3, the current status of ADR mechanism for medical disputes in K City is illustrated. In Chapter 4, the failure and causes of mechanism for medical disputes in K City are analyzed. In Chapter 5, Based on the actual situation of K City, suggestions on ADR mechanism for medical dispute resolution in K City are proposed. Chapter 6 Conclusion.
