Research On The Legal System Of Local Government Bonds In China

With the reform increasingly deepening,the scale of local government debt in our country is enormous at present,but local government bond is an effective way of solving the problem.Local government bond has mainly experienced a long process of development in the western developed countries and becomes a mature tool for financing of the local governments.In 2009,China tried to reissue local government bond.In 2014.the new "Budget Law" allowed local government to issue bond.And in 2015,the new "Budget Law" was put into full implementation.During this period from 2009 to 2015,local government bond has developed rapidly and it has made positive contributions to the local economic development.We can say that local government bond takes a very important position in the platform of local financing.However.the period of issuing local government bond of our country is short after all,the jurisprudence is not complete and there exist some defects in various aspects of supervision.Therefore.we should solve all kinds of problems of local government bonds in our country to push up the local economic development.The body part of this thesis is totally divided into 6 parts.The first part illustrates the research goal and significance,research status,research ideas and methods thesis.The second part introduces the fundamental theory of local government bond in detail,including the concepts, the categories and the features.The third part mainly introduces legal situation of the management and information disclosure of the local government bond in the countries such as America,Japan,Brazil and so on.The fourth part mainly elaborates the current situation of the local government bond of our country.It begins with this part by summarizing the actuality of the local government bond our country in many aspects like issuing,repaying and credit rating in 2015 and then introduces the content of bond sale.Then it illustrates the current situation in law and analyzes some existing legal problems respectively.The fifth prat and sixth part are the key points of this essay.Firstly,the fifth part analyzes the problems of the local government bond of our country existing in the following aspects,namely,the aspect of jurisprudence.the aspect of the credit rating,information disclosure and supervision in supervising and the aspect of repayment system.Finally,the sixth part proposes a series of suggestions according to the existing problems and gives advice on perfecting the jurisprudence of the local government bond of our country, optimizing the system of credit rating,information disclosure and supervision and completing repayment system.Suiting the remedy to the case and providing feasible advice to solve the problems existing in local government bond make the local government bond exert better influence.
