Research On Issues Related To The Government Price Hearing System In China

Government price hearing is a component part of the administrative hearing, its value and significance is to fully know about public opinions and to protect the rights of citizens on the premise of not damaging the business operators and the market economy. The government price hearing system of China was formally established in 1998 because of various reasons. Then the introduction of a series of legal documents gradually improves the price hearing system.The present price hearing system includes four aspects:first, the principle of hearing, it is the main idea and spirit throughout the whole process of hearing. Meanwhile, it also has normative validity and guiding significance to the hearing. Second, the organization of hearing which involves the ways for choosing hearing participants, the rights and the duties of participants and so on. The purpose is to prepare for the hearing. Third, the procedure of hearing, it is the core content of the hearing system. It sets the procedure of the beginning of the hearing, the procedures during the hearing and the subsequent works after the hearing. Fourth, the legal responsibility, which clearly states the legal responsibilities and disciplinary measures of relevant government departments and staff who in violation of price hearing system.The price hearing system in China has many advantages, such as the simple procedure, material guarantee and so on, but the present system which has been a very long time is mainly based on the government prices hearings in 2008. With the social development, the enhancement of the protection of civil rights and the administrative reform and so on, the drawbacks of present price hearing system have become increasingly obvious and need to be solved urgently. In order to solve these problems and to develop and perfect the government price hearing system in our country, we should learn advanced experiences and draw lessons from other countries and combined it with the defects of price hearing system in China, our national conditions and the trend of social development.This paper includes four parts:The first part mainly discusses the basic theory of China’s present government price hearing system, elaborates the concept of the government price hearing, and the value and significance of China’s price hearing and so on.The second part mainly summarizes the advantages and disadvantages of China’s present government pricing hearing system, in order to pave the way for improving the hearing system.The third part mainly investigates the content and the characteristics of the price hearing system of America and German, in order to learn and draw lessons from them.The fourth part is mainly about the advices for the improvement and development of the price hearing system in China.
