Legal Research On Arrear Wage’s Problem Of Migrant Workers In The Field Of Architecture

Since China’s reform and opening up, China’s overall outlook has occured an earth-shaking change. On the one hand, our country economy obtains an unprecedented rapid development; on the other hand, with the deepening of the reform, the market economy continues to expand, and more rural surplus labor forces join the urban migrant workers wave, then form a new group named "migrant workers" which fulls of Chinese characteristics. This group’s emergence plays an indelible role in promoting the urbanization process, but it also leads the "migrant workers" problems come. For these problems, the scholars in our country and abroad each have paid great attention, and thus formed the combination of demography, sociology, urban science, economics, law and other disciplines. Now they all involve in the research about the problem of "migrant workers". "Migrant workers" problem has a very wide range of industries and its contained content, at this point, this article will mainly from the legal perspective to explores the problem of wage arrears of construction workers.In China, "migrant workers" in the construction industry has made great contribution to the development of the city, but their rights haven’t been enough protected, even the wage payment which is the most basic right to them. In fact, the large scope, high number and unpaid wages for a long period behavior not only damage the basic survival of "migrant workers" in the construction industry, but also damage the country’s legal authority, social justice. So, it is the requirement of our social harmony to explore the wage right protection of the "migrant workers" in the construction industry and give the countermeasures now, at the same time, it is also the responsibility of the whole society.The emergence of China’s "migrant workers" in the construction industry has deep social reasons, in order to have a profound knowledge of related definitions before our research, the first chapter of this article defines the concept of wages, wage arrears behavior. Through the research, we found that the wage arrears phenomenon is caused by the collection of many different reasons, after the summary about the default behavior’s characteristics, the second chapter of this article analyzes the reasons of this phenomenon, which mainly from the aspects of the construction industry’s own system and the legal system of right relief. After reflecting on our own problems, the third chapter will focus to the related laws and regulations and policies about wage arrears resolvent of Hong Kong and Taiwan in our country, then summarize their similarities and differences in order to sum up some experience. Through the above analysis, in order to perfect the law mechanism, the last part of this article puts forward some suggestions which mainly include entity law and procedure law system promote measures, to solve the wage arrears problem of "migrant workers" in the construction industry.
