Democracy and the rule of law is a common political ideal of mankind as well as the key part in theconstruction of Chinese political civilization. In the modern times, the political value of democracy isgenerally acknowledged by the public while the whole world is marching on the democratic way. Ourcountry’s basic level of democracy construction is carrying on in all walks of life as an important part of thedemocratization reform. In the field of education, the Teachers Congress (TC for short) is the legal formin which the faculty and staff participate in democratic management and exercise their democratic rights. Itis also the primary element of the system construction in modern schools of our country.This article emphasized the fact that TC plays an indispensable role in school basic management bytrailing the history of TC and its functions. Then, a survey was conducted on how TC works in primary andsecondary schools in S city. The survey learned the specific situation in reports, proposals, resolutions andexecution of TC and revealed that there were various problems in TC. The problems found mainly werethat substantial progress in the democratic management of the school was not significant, that schoolleaders dominated TC’s decision-making that schools seldom made any progress in democraticmanagement, and that report lack of financial content and that TC’s resolution were difficult to implement.What’s more, the operation of TC was not rigorous, with the problems of lacking rules, sloppy preparatorywork and insufficient proceedings etc.TC also lack of institutional security and protection of the rights ofteachers. After analyzing these problems, this article extended the reason of distorted operation of TC. Thedistortion was exposed in the absence of procedure considering proposal practice and the lack of programswhich embodied the rights of TC to supervise and evaluate school leading cadres. From the viewpoints ofdemocratic thought, psychological factors and right relief, the thesis analyzed and extended the reasons forthe distortion of TC operation by using the power of democracy theory, group dynamics theory and thetheory of right relief. In terms of democratic thought, there showed little critical spirit and liberal spirit inthe school, where democracy was hampered by traditional culture, dependent attribute of education, theadministrative press and social utilitarian environment. In terms of psychological factors, the psychologicalsituation of the faculty was ignored in the process of TC operation, which maintains and strengthens thefaculty’s inclination to conservation and obedience. In terms of right relief, TC’s right was going down overand over again in the lack of clauses for relief in TC system, in seldom safeguarding ordinary teachers’right, and in lengthiness and insufficiency to fight for rights. Finally, the thesis put forward somecorresponding strategies: continuously culturing teachers’ democratic thought, paying attention to thedetails of maintaining teachers’group psychology in the operation of TC, and making laws to safeguard TCand teachers’ right relief. By doing so, TC could play the role in inside-out democratic management,safeguard teachers’legal rights, and promote the democratic development of schools and education.
