On The Perfection Of The Legal System Of Industrial Injury

China since the early 90’s, officially entered the period of rapid development of industrialization, at the same time, the risk in our country enterprise workers suffering from occupational hazards is also gradually increased, and the industrial injury insurance system has not kept pace with the development of economy, and even some lag, the protection for the legitimate rights and interests of workers, stable and harmonious society is its negative. Therefore, it has theoretical and practical significance to perfect our legal system of industrial injury determination. For the protection of workers can timely access to healthcare and economic compensation in the event of injury, the promotion of industrial injury prevention and vocational rehabilitation, dispersing the risk of injury of person’s unit, in January 1, 2004 China promulgated and implemented the "Regulations" industrial injury insurance, and in 2011 were revised and improved, compared to foreign countries has been implemented for decades or even centuries of industrial injury insurance system, China’s industrial injury insurance policy relatively immature, especially on work-related injury confirmation aspects, provides a relatively shallow, it is difficult to adapt to the rapid development of the society.This paper takes the materialist dialectics as a guide, the scientific use of comparative analysis, empirical analysis, systems analysis, literature research methods, analysis of China’s industrial injury determination of difficult problems encountered in the work, and use the western developed countries recognized the historical experience in industrial injury, to improve the identification of legal system to provide reference in China the injury. At the same time, the combination of my daily job injury identification work, theory with practice, puts forward some original suggestions, trying to make some contributions to improve China’s legal system to ensure the ascertainment of a work-related injury, in our country the legal rights of injured workers to obtain the effective safeguard.
