Our Groundwater Resources Protection Legal System Research

Groundwater is an important body of water on the Earth and it has a close relationship with the human society.With the development of economy and society,the number of population is increasing,and our country is facing to the serious problems,for example,the over exploitation of the groundwater resources,the pollution of groundwater resources and the destruction of the ecological environment.The legal system of groundwater resources protection in China is not compatible with the severe reality.In this paper,some problems existing in the legal system of groundwater resources protection are put forward,and give some reasonable proposals.Groundwater Resources Protection Issue of Basic Theory.The thesis is divided into five parts:The first part is an introduction,from the research background,research value,research methods briefly described.The second part is an basic theory of groundwater resources protection issue,introduces the concept of determining groundwater resources,the four characteristics of groundwater resources and the establishment of its own legal system to protect the legal basis.The third part expounds the present situation of the underground water resources in China,points out a series of difficulties of the groundwater resources,and analyzes the causes of the disadvantageous situation.The fourth part,it points out the defects existed in the protection of groundwater resources in China,including lags behind the legislative process,configuration imbalance of rights and obligations,the relevant legal system is not perfect,management system is not reasonable,legal punishment is not strict.The fifth part of the paper is the characteristics of groundwater resources protection legislation,mainly introduces the United States,Australia,Holland and Britain,the characteristics of the system in the four countries,providing the reference for the protection of groundwater resources to our country.The last part for the problems of the groundwater resources in our country, draw lessons from foreign successful management pattern and legal system,from the perfect legislative principles to coordinating the existing laws and regulations,to achieve the goal of "dynamic groundwater resources protection law”;In the content of legislation,puting forward an additional incentive clauses,filling in the criminal law penalties for lack of the laws and regulations of a deterrent. Aiming at the water permition system of groundwater resources in our country,the over exploitation of management system,the emergency warning systemare putting forward to correspond suggestions.At the same time,this paper suggests that establishing the long-term groundwater resources supervision system,correctly handles the unified supervision and decentralization,and accomplishes all departments performing their respective duties,effective negotiation,the basic information sharing and cooperation with each other.
