Although the Environmental Law in China has made great achievements nowadays, and the way of environmental protection has diversed. In terms of extent, "executive-led" is still the main form of environmental protection in our country, mainly for environmental executive with a dominant position to promote the development of environmental law in the legal structure of our environment. So the executive powers will have a greater impact on China’s environmental protection objectives to realize. The macro background of environmental law and the implementation of sustainable development, I use environmental administrative penalty system as the theme, from the legal administrative law and environmental law legal point system to demonstrate the operation mechanism of environmental administrative punishment system, and from static and dynamic two dimension analysis demonstrate environmental administrative penalty system. In the static level is conceptual, theoretical basis and value the pursuit of environmental administrative penalty system and the main content analysis; the dynamic level is the mainly for environmental administrative penalty system configuration, operating conditions and supervision discussed, trying to be able to put forward proposals to improve the system of administrative penalties, in order to safeguard the interests of administrative relative person’s and the environment, to further promote the development of the ecological environment.
