Study On Government’s Environmental Responsibility

Environmental problem is one of the most serious problems so far faced by mankind. In 1972," Environmental Protection" was brought up as a clear concept in United Nations Conference on Human Environment. After a long struggle, China enacted Law of Environmental Protection of the People’s Republic of China(Here in after referred to as the old law) in 1989,and then the law was revised comprehensively on April 24,2014.The new revised Law of Environmental Protection of the People’s Republic of China(Here in after referred to as the new law) was amended significantly, the law makes more detail rules on the government’s environmental responsibility.It is an important step to realize good environmental governance that improve the government’s environmental responsibility.The regulations about government’s environmental responsibility in the amendment of Law of Environment Protection not only pay attention to governmental positive duty in the aspect of environmental protection, such as performing duty actively,supervision and administration,but also put emphasis on governmental negative duty,such as the unfavorable legal consequences of not performing environmental protection duty.The paper makes a summary of lessons drawn in the environmental governance by law, and the paper makes targeted research. The paper researches on the government’s environmental responsibility basing on the provisions about governmental responsibility, and then make a comprehensive analysis of government accountability through Chinese and Foreign different provisions. At last, the paper will give some suggestions on the improving of government’s environmental responsibility.
