On The Legal Regulation Of On-Line Monitoring Technology In Environmental Governance

With the continuous development of science and technology,the role of technology in environmental management is growing,and online monitoring technology is a new measure to solve our environmental problems and a new choice in line with environmental practice.In this paper,the use of on-line monitoring technology in environmental management as the research topic,analyzes the outstanding problems and their causes in reality,and tries to put forward the legal path of online monitoring technology in environmental management.Articles in addition to the introduction is divided into three parts:The first part is the theoretical basis of online monitoring technology in environmental management.I provide a unified tool for reading,the "online monitoring technology","environmental governance","online monitoring technology in the use of environmental management," made a detailed interpretation of the concept.At the same time,the interaction between online monitoring technology and environmental governance is analyzed.The second part is the real dilemma and its causes of online monitoring technology in environmental management.In the full recognition of online monitoring technology to bring about positive changes in environmental governance at the same time,also analyzed the many dilemmas and their causes,mainly as follows:online monitoring of the legal norms are not complete,such as low legal norms,legal norms of continuous Such as online monitoring and environmental law enforcement out of line,the judicial function is not in place,law-abiding concept is not established;online monitoring of the rule of law supervision is not tight,such as the supervision of the legal liability of the object is not clear,the lack of legal norms exist;Bit,information sharing mechanism is not perfect,public supervision and participation of low.The third part is the legal path of online monitoring technology in environmental management.In view of the above problems,this paper puts forward three countermeasures and suggestions:First,improve the legal system of on-line monitoring,including improving the legal rank of online monitoring,enhancing the continuity of legal norms,filling the gaps in online monitoring,Second,to achieve efficient online monitoring of the implementation mechanism of the rule of law,including the convergence of online monitoring and environmental law enforcement,give full play to the role of judicial functions,and establish advanced law-abiding ideas;Third,strengthen the strict monitoring system of online supervision,The legal responsibility,improve the online monitoring information sharing mechanism,improve public participation and so on.
