Empirical Study On Anhui Province Environmental Protection Legislation

As the people of the awakening of environmental consciousness in recent years,local environmental legislation is increasingly prominent in the position in local legislation,environmental protection has become a hot topic provinces and even the national legislation.The first part starts from the definition of environmental meaning.And then we made a distinction between environmental protection and urban management and the concept of historical and cultural protection.Urban and rural construction and management focus on urban and rural construction,infrastructure management planning,and "urban and rural" in environmental protection is mainly aimed at environmental sanitation part;The identification point of historical and cultural protection and environmental protection needs to start from cultural value and ecological value.In the end,environmental protection is translated as:ecological protection of the atmosphere,water,sea,land,mineral deposits,forests,grasslands,wetlands,wildlife,natural and cultural relics,natural reserves,scenic spots,and environmental protection of urban and rural areas.Then the author from the priority protection,prevention,public participation three principle,explaining the principle of environmental protection legislation.The second part is the point of this article,first of all,from the legislative induction,the legislative proportion,the legislative matters three aspects of the Anhui province environmental protection legislation overview analysis.The second chapter is based on the Anhui Province Environmental Protection Legislation,the Anhui province environmental protection legislation of environmental administrative subject,in terms of legal liability,the government risk prevention of liability clause,on the terms of legal supervision.Finally,this chapter on the basis of the above empirical analysis,summarized the Anhui province environmental protection legislation defects,embodied in:the uneven distribution of Anhui province environmental protection legislation,for matters of environmental protection legislation,exists the phenomenon of concentration,protection priority still needs to continue to implement the legislative concept,some areas remained blank of the legislation;environmental protection legislation lacks local legislative characteristics;the law of responsibility of environmental administrative subject is general;the government risks prevent the uneven distribution of each factor;the public participation degree is insufficient and the environmental administrative supervision is mostly to punish afterwards;law enforcement conflict.The third part of local environmental legislation in Anhui province on the basis of empirical analysis,draws the experiences of other domestic local environment,to the Anhui province of the defects in environmental protection,respectively,from five aspects in Anhui province environmental protection legislation of detailed legal idea.The specific proposal is to balance legislative matters and fill legislative blanks.To fully developing the legislative characteristics of local environmental protection;expanding the accountability subject and refine the accountability clause;Increasing government environmental risk prevention legislation progress,strengthen public participation;establishing procedures to supervise the operation mechanism;rational distribution of environmental enforcement rights.
