Study On Social Relief Of Health Damage Caused By Heavy Metal Pollution In The Soil

At present,the incident that the soil is polluted and damaged by heavy metal occurs frequently all over China.It not only causes serious health damage to the victims,but also brings about spiritual pain and torture in them.Due to the lack of laws and regulations on compensation for health damage caused by the current environmental pollution in China,the victims cannot be remedied timely and effectively,leading to further deterioration of damage.As a result,social harmony and stability are affected,and people’s health rights and interests cannot be ensured.In order to promptly and effectively remedy the victims suffering from health damage caused by heavy metal pollution in the soil,the damage shall be regarded as damage to the society so that the majority of people in the society can provide relief to them.Thus,health rights and interests can be guaranteed,and their damage can be compensated.At the same time,the preparation can be well made for those victims in the subsequent possible occurrence of heavy metal pollution.In this paper,the present situation of social relief for those suffering from health damage caused by heavy metal pollution in the soil of China and the existing problems are analyzed.On basis of experiences in social relief for environmental infringement in the United States,Germany and Japan and in combination with the actual situation of China,the improvement in the content of compulsory insurance for environment pollution and proposals for forcing metal pollution enterprises to ensure are discussed to implement the security functions of insurance.At the same time,the preparations are made for relief for health damage caused by heavy metal pollution of soil through the establishment of mutual funds and sinking funds for heavy metal companies and other financial measures.If necessary,the relief fund for pollution damage is established to ensure implementation of rapid relief to the victims in the case that the polluter disappears,or he/she has no ability to undertake responsibility or has no insurance for environmental pollution liability or financial security,etc.
