A Study On Legislation Of Carbon Capture And Storage

The increasing emissions of greenhouse gas in the industrial production process have resulted to the serious climate changes.The climate changes have definitely made some dire consequences,such as: rising the sea level,reducing the fresh water,seriously damaging the ecological balance and human health,etc.Currently,the global greenhouse gases control measures mainly include: development of energy conservation and emissions reduction technologies,development of clean energy and improvement of energy efficiency,etc.As one of the energy conservation and emissions reduction,CCS(carbon capture and storage)technology is welcomed by many countries for the bright development prospects that involve the immense potential for emissions reduction.Basically,research of legal system and construction of legislative of CCS technology,both of which will be in favor of providing the legal guarantee for the development of this technology.As the rapidly development of the global CCS projects,the integrated legislation of CCS technologies and the special laws and regulations of carbon dioxide’s geological sequestration have been gradually established and completed.Basically,lots of countries standardize the healthy development of this technology in their own countries by legislations.In China,however,this technology’s legislation norm is still blank,it is widely believed that such situation is not good for the long-term development of this technology and also guarding against technical risk.This article start from the overview of CCS technology,in order to fill a vacancy in our law of CCS technology,discuss the necessity for development and regulation of the CCS technology,put forward some ideas for construction of legal system of our country’s CCS technology by means of investigate main law issues of CCS technology from other developed countries.The article chapter one starts from the concept of the CCS technology,and then discuss about the concept,theoretical basis and content of CCS laws and regulations.The article second chapter focuses on necessity and feasibility of CCS in China for several aspects,such as the national’s technology policy,project construction andinternational cooperation.And meanwhile,analyzing the necessity for the legislation of CCS technology,such as the current law unable to standardize,the technology exists enormous risk and the needs of the development of technology.The article third chapter discuss about the development status for legal system of CCS in some developed countries,primarily take European Union,the United States and Australia as example to discuss and analyze the legal issues of CCS law.The article fourth chapter discusses the idea of constructions of CCS law system.As the basic of designing the objective,principle,regulators and their responsibilities of legislation in our countries,establish the specialized laws of regulated CCS,and completed the related supporting system of legislation.
