Research On Improving The Third Party Mediation Mechanism Of Medical Dispute----Based On Some Prefecture-level City In Northeast China

In the overall background of social reform and the frequent tensions between medical staff and patients in transitional period,the traditional mechanism of dispute settlement between medical staff and patients which relies on mutual consultation,administrative mediation and judicial litigation has been revealing its malpractice.With the establishment of the Medical Dispute Mediation Commission and the implementation of medical liability insurance,the third party mediation mechanism of medical dispute mediation provides a new buffer platform for medical staff and patients.However,due to the lack of relevant theoretical direction and legal norm,the third party mediation mechanism of medical dispute in Liaoning has developed unevenly.Take X City as an example,its Medical Dispute Mediation Commission is in the phase of gradual improvement,medical liability insurance is on the preliminary stage of being fully implemented,there are some common problems in exploration of the third party mediation mechanism of medical dispute of the province and they are urgent to be standardized and improved.This article mainly employs the qualitative research method,obtained the primary data through the interviews with patients,medical staff,Medical Dispute Mediation Commission,insurance company,medical malpractice assessment institution and other key participants and utilize qualitative data analysis tool-Nvivo11 for coding and modeling and makes an in-depth analysis of the advantages and problems about the third party mediation mechanism of medical dispute,thus we can see there are three major reasons for the poor system operation,the imperfect medical dispute settlement system,the defective third party medical dispute mediation internal operation system and the external supporting mechanism is lagging behind.Regarding to this,the author puts forward some suggestions on how to create a pluralistic classification of medical dispute settlement system,clarifying the government responsibilities,strengthen the legislation construction,promoting the standardization construction,cultivating the compound mediation talents,improving the third party mediation supporting mechanism of medical disputes.Hope this article can further exploit the advantages of the third party mediation mechanism of medical dispute and help X City to gradually get rid of the existing predicaments in solving disputes between medical staff and patients in order to promote the X City medical dispute third party mediation mechanism reform,in order to promote the reform of the third party mediation mechanism of medical dispute in X City,which also will become the preliminary research foundation for medical dispute third party mediation mechanism suggestions in Liaoning province which conveys significant realistic meaning.
