From the birth of translation,most of the translators and translation theorists have been devoted to the study of translation based on fidelity,which has focused on “how to translate” or “how to translate perfectly” all the time.“Culture Turn” makes translation study focus on target language.French sociologist Robert Escarpit proposed the theory of “Creative Treason” and thought that “Translation is the process of Creative Treason”.Creative treason reveals the collision,fusion and betrayal from the source language to target language.Using the theory Hermeneutics,this thesis considers translation as the process of understanding and explaining.With the exploration of two important notions in Hermeneutics: Pre-understanding and Horizon Fusion,the author proposes that translation or even cultural communication is actually one fusion among different horizons.Then the author of the thesis finds out that pre-understanding leads to creative treason,and creative treason that is rooted in certain context is exactly the representation of horizon fusion between two cultures,which clearly shows the relationship between Hermeneutics and creative treason,and explains the legality of creative treason using Hermeneutics.Creative treason has close connection with translators' subjectivity and inter-subjectivity.Actually,translators' subjectivity is just a personal factor that affects translation,and the dominant factor must be called translation subjectivity.Creative treason is the reflection of subjectivity,and subjectivity of creative treason is not translators that is just the personal factor in translation but translation subjectivity.In addition,the author studies that translation subjectivity must be inter-subjectivity.Then the author analyzes translation subjectivity and multiple subjects,which immediately reveals that treason needs a“moderation” in creative treason.Next,this thesis chooses the English version of The Garlic Ballads translated by Howard Goldblatt as a case,and analyzes creative treason happened in Chinese-to-English translation at both linguistic level and cultural level.Through case study and connecting some major factors that affect creative treason,the author makes a further research that how fusion happens with different cultures,and how to control creative treason when translating.Under the background of culture turn,the study of creative treason that reveals the collision and fusion in cultural communication has valuable significance in translation study.Using combination of theory study and case analysis,this thesis explains and proves that translation can not go without creative treason which is an inevitable phenomenon in translation not a translation strategy.Due to creative treason,the source text can be refreshing.The translation of an excellent literature work needs creative treason,but the translator must balance the creativity and treason.
