Research On Copyright Infringement Of Self-media

With advances in Internet technology,self-media has earned its place as an instrument for daily communication.Over a large amount of copyright infringements on self-media works,infringes taking measures against copyright infringements can no longer have a punishable and deterrent effect on infringers.Even worse,infringes notifying the network operators on the platform of self-media of removing links on copyright infringements and resorting to litigation are also of little help to safeguard infringes against copyright infringements.From the perspective of presenting classic lawsuits,the paper is to reveal the difficult points in protections against copyright infringements of self-media works,and discuss the issues of difficulty in bearing the burden of proof and low amount of damages,putting forward some suggestions for providing against copyright infringements in order for the self-media and the cultural communication to be better protected.There are five parts in this paper,excluding the parts of introduction and conclusion.The first part analyses the concept of self-media,defines the copyright of self-media works and categorizes the copyright infringement and the tort liability on self-media's platform.The second part reveals the features of copyright infringements of self-media works in legal action,seeks out the difficulty in securing the right of the infringes and necessity of improving laws of burden of proof and damages on copyright infringements of self-media.The third part discusses the imputation principles of copyright infringements of self-media and singles out the proper imputation principles fit for the copyright infringement of self-media in China.The fourth part explores the elements of tort liability ofcopyright infringement of self-media and specifies them and the disclaimer of the copyright infringement of self-media.The fifth part expounds the damages system of copyright infringement of self-media and proposes some suggestions.
