A Research On The Protection Of The Right To Adequate Housing In Human Rights White Paper

Housing is the most basic material condition for human beings,the realization of the right to adequate housing is related to people's survival and development,the right to adequate housing is a fundamental human right that has become a common perception of the present international community.However,with the development of society,the continuous improvement of the degree of marketization,and the imperfection of the relevant housing security system,the right to adequate housing has not been effectively protected.In the protection of civil liberties at the same time,there is no reasonable protection of citizens of the residential social rights,the characteristic of social rights continue to highlight,this is obviously outdated.In order to better protect the right to adequate housing,it is necessary to protect citizens' right of freedom at the same time,and to fully protect the citizens' social right,so the state need to take positive action and effective measures.the human rights white paper of China just confirms this point,the provisions of the content of the right to adequate housing require the country's positive action,and it reflects the characteristic of social rights.I hope improve China's housing rights system through the analysis of human rights white paper in terms of content.Based on this,the author intend to explore the protection of the right to adequate housing in four respects.The first part of the article intends to analyze human rights white paper in order to carry out a more complete combing about human rights white paper.Through the study of the human rights white paper in China over the years,it is not difficult to find out that the human rights white paper in the past year mainly describes the content of living conditions and housing security,such as the continuous improvement of living conditions,the protection of ethnic minorities and other special hardship groups,security housing.In fact,it stresses social right,and it is clearly seen that the effective protection of the right to adequate housing needs the state's positive action,simultaneously,it needs to focus on the characteristic of social rights.The second part of the article intends to analyze the difficult of the protection of the right to adequate housing in the human rights white paper.At the present stage,with the development of society and the continuous improvement of the degree of marketization,the protection of the right to adequate housing in China is facing many problems,the price ofhouse increase sharply,housing quality problems,housing equality rights are infringed,the infringement of public power is common.The third part of the article intends to analyze the reason of the difficult of protection of the right to adequate housing in the human rights white paper.the protection of the right to adequate housing is now facing a lot of real problems,mainly include the following four reasons: Firstly,the concept of social right is missing;Second,the lack of housing law;Third,the lack of judicial protection of the right to adequate housing;the fourth is the improper exercise of the executive power.The fourth part of the article intends to analyze the protection of the right to adequate housing.Based on China's special national conditions,the protection of the right to adequate housing is faced with many problems,so in order to better protect the right to adequate housing that is referred in the human rights white paper,the author suggested provide some protection include the constitutional level,special legislative level,private law level and departmental law coordination level.
