The Conflict Of Interest And The Maintenance Of Order In China's Rural Land Approval Registration

The thesis focus on the conflicting interests and order rebuilding of the approval registration certification for contractual operation rights on rural land. With empirical investigation of the case village, the thesis intends to show the developing progress before, in and after implementation of the policy, and explore farmers' expressed attitudes, behavioral selection and respond'ing effect on the policy of the contractual right of rural land in different stages. From different perspectives, the thesis is about finding interest expression, interest conflict of the policy and maintaining of rural order after conflict of subjects like farmers, villages' group, villages' committee and local government.Based on the above contents, the thesis sums up and responds to the facing challenges of the policy of registration of the contractual right of rural land, and makes path assumptions to get out of the difficult situation, aiming at successfully implementing the rural land registration policy. This way, it can realize the significance of rural land property rights system, promote the land circulation, improve the land utilization, speed up the construction of modern agriculture, guarantee the realization of farmers' lawful rights and interests, keep rural order and promote the comprehensive development of society.In the aspect of conflict of interest,order to maintain and reconstruction, the author put three variables into the research, there are power, right and interest, as well as and emotion.The author analyzes the causes of conflict of interest from these variables.Specifically, the author analyzes the power of obedience and resistance, the disregard and protection of rights and interests, the rejection and approval of emotions. These three variables are independent and interacting with each other. They work together in the production, activation and dissolution of conflicts of interest. The dynamic analysis of these three variables, it is important for us to realize the approval registration certification for contractual operation rights on rural land accurately, and has a profoundly influence on conflict resolution, moreover, it has positive effect on promoting rural social development.Furthermore, the author analyzes farmer's practical logic in the approval registration certification for contractual operation rights on rural land, the thesis is introduced the"economic man" hypothesis theory and the "political man" hypothesis, based on these,the one practice logic is established to maximize profit, and the other practical logic characterized by political participation. Both are independent and interact with each other,this two things both exist in the progress of the implementation of the policy, especially it has an important influence on the conflict of interest. The "divergence" and "consensus"caused by this two practice logic in the rural society, have much important significance on solving the contradictions, stabilizing the social order, and promoting democratic politics construction.
