With the deepening of the study of economics and meteorology,governments have seen the impact of human activities on climate which is based on climate governance theory and atmospheric data over the past few decades,and also realize that the governance of climate anomalies requires not only the domestic economic legislation,but also the joint efforts of the rules of trade around the countries.Western developed countries like America take the lead in considering the implementation of carbon tariffs to solve the problem,which is international market competition and carbon leakage.The background of carbon tariffs mainly concerns the development of international trade,the arrival of global climate anomalies and international climate negotiations on climate change.On the basis of defining carbon tariff,the paper summarizes the attributes of carbon tariff from two aspects: international climate governance measures and international trade regulation measures.Then the paper discusses the legislation of carbon tariff,including France,the United States and the EU.The legitimacy of carbon tariff is analyzed from the point of view of international climate governance justice value and fair value.In the framework of WTO,the legitimacy of carbon tariffs is analyzed.The export data in china analyses the negative effects of carbon tariffs on economy and trade: the loss of the Chinese manufacturing advantage and the pace of economic development which is slowed in China.Causes of the negative effects involve two aspect: the developed countries take advantage of hegemony to fight for the discourse power of environmental protection;our country lacks international competitiveness.Considering the problems above,our country prepares from international law and domestic law to solve it.The perspective of international law is constructing a coordination mechanism among trade liberalization and environmental protection,and effectively using WTO rules to solve the trade friction.From the perspective of national law,China should improve and perfect the legal system of domestic climate governance,and consummate the legal system of low carbon development.
