In December 2016,Xi Jinping pointed out at the 14 th meeting of the Central Financial Leading Group that it is necessary to accurately grasp the residential attributes of China's housing and establish a housing system that promotes the simultaneous purchase of rent so that all people can live.Since the public rental housing system was put forward for nearly 10 years,the public rental housing system has been continuously improving.However,in the process of development,due to the lack of uniform housing legislation and related supporting laws and regulations,and the implementation time of the system is relatively short compared to other countries where the housing security system is relatively complete,it lacks sufficient experience,and local governments appear in the process of implementation.Some questions worth pondering are reflected behind these questions,which reflect the absence and imperfection of relevant legislation in our country.After deepening understanding of the relevant policies of the Party Central Committee on China's public rental housing system,this paper proposes the problems and deficiencies existing in the public rental housing sector in China,and refers to several countries that have relatively improved foreign public housing security systems.The public housing system provides some valuable references for the development of public rental housing in China in terms of legal systems.Besides the introduction and conclusion,the article has the following four chapters.The first chapter is an overview of the public rental housing system.First of all,several different concepts of public rental housing are studied.The characteristics and meanings of public rental housing under different concepts are not the same.The article argues that public rental housing refers to the limited construction standards and the level of rent,participation of various social entities,and provision of affordable housing for a broad range of standards-compliant target groups.Then it introduced the legal basis of public rental housing,sought legal theoretical support for the public rental housing system,and determined the function and positioning ofpublic rental housing.The article argues that public rental housing contributes to social justice,legal prevention and resolution of power levels.By analyzing and summarizing the characteristics of public rental housing and distinguishing it from other types of affordable housing,the characteristics of public rental housing are put forward.According to the characteristics of public rental housing,the real value of public rental housing system is summed up.The social significance of existence.Finally,we reviewed the development history of public rental housing system in China,and related legal documents and policy documents.The second chapter is the key chapter in this article.It analyzes the implementation of public rental housing system in our country and briefly summarizes the implementation of public rental housing in China as a whole and in several major cities.Taking China's Xiamen and Beijing as examples,the paper analyzes and summarizes the implementation of the public rental housing system in detail.Summarized the relevant provisions of the laws,regulations,and policies of the public rental housing system,and proposed the problems existing in the public rental housing system in China.The article considers that there are mainly the following problems: 1.The lack of legal provisions in the supply of land and other links;2.The lack of relevant legal provisions for the planning of public rental housing;3.The single financing model of public rental housing,and no related legislation;4.Public leasing There are no relevant legal provisions for the operation of housing.The third chapter summarizes and makes reference to the country's systems,laws,and regulations that are relatively complete in several foreign public housing security systems.Mainly the same countries in Germany and Japan,the civil law system,the article that Germany's sound legislation and encourage private housing rental,specifically for rent legislation and intervention,Japan's dual housing system for our reference.In addition,for the United States and Singapore,which have relatively perfect legal system,the article states that both the United States and Singapore have perfect housing legislation.The unique US taxation policy has a positive effect on the financing of public rental housing,and Singapore's strict standards apply.The admission and penalty mechanisms are also worthy of our country's reference.On thebasis of adapting to China's national conditions and traditions,this chapter provides a theoretical basis for the fourth chapter to provide suggestions for the public rental housing system in China.The fourth chapter summarizes and summarizes the contents of the above chapters,and refers to the advanced concepts,basic principles,laws,and regulations of foreign public housing development.Based on China's national conditions,cultural traditions,and the status quo of public rental housing development,the reference is made.Suggest.There are mainly the following points: 1.Legislation on China's housing system,and a special chapter on the legal system for public rental housing;2.Improvement of relevant laws and regulations on public rental housing planning;3.Improvement of laws and regulations on public rental housing financing model;Improve the laws and regulations for public rental housing operations.
