A Study Of The Legal System Concerning Public Participation In Urban Transportation Planning

In recent years,the contradiction between supply and demand in urban transportation has been increasingly prominent.It is an inevitable choice to ease current problems in urban transportation by strengthening the construction of urban transportation system.Public participation in urban transportation planning is a demonstration of civil democratic right.It is an effective way to make scientific and democratic urban transportation planning through public participation in the making,confirmation,application and modification of it.Public participation also has positive effect on urban transportation planning and is of great significance to both academic theories and the reality.This thesis focuses the legal system of public participation concerning urban transportation planning.First,starting with the concepts of public participation and urban transportation planning,the author argues about the special value of public participation in urban transportation planning,such as the abuse of discretion in regulatory planning,avoiding expert capture,to achieve a balance between different interests and values,and the prevention relief after the implementation of prevention planning.Second,based on different phases,the author discusses the design of public participation in urban transportation planning and analyzes its institutional absence in the respects of the participation stage,participation model,participation procedure,feedback and relief provisions.Finally,the author has a simple discussion of the extraterritorial practices and experiences about their organization,legal protection and participation procedure of public participation in urban transportation planning,which may provide theoretical and practical references for China.The author also puts forward some suggestions in promoting the normalization of public participation in urban transportation planning,Including the standard and organization guarantee,relief mechanism,and the improvement of supporting measures.Hopefully,this thesis is helpful and referable in the institutionalization of public participation concerning urban transportation planning in China.
