The Realistic Predicament And Perfection Of Community Correction In China

Community correction as a kind of no prison punishment measures is the result of the further development of modern penalty theory,such as socialization of execution,economy and individualization of penalty.It is also the product of the increasingly rule of law,civilization,humanization and socialization of the concept of penalty work in China.Community correction through supervision and management,educational correction and help help to correct the criminal psychology and behavior of the offender from the source,to promote the smooth return of the society,for the control and prevention of crime is of positive significance.Community correction has been developed for more than 100 years in developed countries such as Europe,America,Japan and other developed countries.In contrast,our country has introduced community correction for more than 10 years to develop rapidly and popularize all over the country.The rapid development of short time makes it lags behind the legislative work,and the related theories are not mature and supporting system is not mature.There are still many practical problems,such as imperfect and corrected personnel shortage,lack of professionalism and insufficient participation of social forces.Through the investigation method,the empirical analysis method and the literature research method,this paper analyzes the dilemma of the system design and judicial practice facing the development of community correction in China,and uses comparative research methods to summarize the foreign development experience and mature system,so as to put forward some perfect suggestions for our community correction to get out of the dilemma.The article explains the concept and nature of community correction,puts forward the exploration of constructing professional community correction team and widening the scope of application of community correction objects,and analyzes the community correction law(solicitation draft)issued in December 2016,and puts forward the improvement of community correction law.Three suggestions for the draft.The article also focuses on the analysis of the advantages and development course of community correction in European and American countries and Japan,and combined with the most prominent problems in the work of community correction in China,in order to improve the construction of the system,expand the participation mechanism of social forces,solve the problems in the implementation of the main defects,and the problems of institutional disharmony,and so on.In order to provide solutions for improving the system of community correction and solving practical problems in China.
