A Study Of The Disputes Subject Form And Legal Regulations Of University Students In China

In recent years,there have been frequent disputes among university students in our country.There are disputes concerning the degree assessment,academic qualifications,and other issues concerning school management.With the deepening of the concept of administering the school according to law and administering the school in accordance with the law,the awareness of safeguarding students' rights has gradually increased.Solving school disputes through legal means has been on the agenda.This paper analyzes the types of disputes among school students through case analysis,discusses the main body form of disputes among college students and their legal regulations,and has positive theoretical and practical significance.This paper divides the main types of disputes in school students into three categories:students and college teachers,students and administrative staff,students and logistics socialization employees.It analyzes the nature,rights and obligations of legal relationships between main subjects in relation to typical cases.The main body of the relationship produces differences and characteristics of disputes.Since the school students' disputes.studied in this paper mainly involve three areas of teaching management,business management and logistics management,the characteristics of disputes between different fields have common and individual characteristics.Especially in terms of personality,different types have the specificity of the subject of the dispute,cultural differences,and differences in dispute handling.This paper aims at analyzing the causes of disputes among students in different types of disputes from both macroscopic and microscopic perspectives.On the one hand,it is the rapid economic and social development,the realization of the popularization of higher education,the advancement of the democratic construction of the rule of law,and many disputes in the field of higher education have risen to legal issues.This poses a challenge to the management of the original higher education,and universities in the concept and The system still can not adapt,especially in the vacancy of some dispute resolution mechanisms.On the other hand,the focus is on the growing awareness of students' rights protection.Some of the staff in colleges and universities are relatively indifferent to the rule of law in management and the quality of the rule of law is not high enough.This article believes that strengthening the legal protection of the school students'main body,establishing the prevention mechanism for the school students' disputes,and perfecting the relief system for disputes among university students are the basic ways to fundamentally solve the disputes among school students in different relationships.Strengthening the concept of the rule of law,strengthening legal protection,and establishing a preventive mechanism beforehand are prerequisites and foundations for reducing and preventing disputes.The establishment of a diversified dispute resolution mechanism that combines litigation and non-litigation methods is an effective improvement of dispute relief systems for college students.
