Research On The Legal Nature And Usufructuary System Of The Right To Use Radio Spectrum Resources

The radio spectrum resource is the main carrier of information transmission, it has been widely used in public communication, meteorology, transportation, space science research, national defense construction and other social sectors, therefore, all countries in the world are listed as national strategic resources of the radio spectrum resources. However, with the progress of radio technology, the state vigorously promote the consumption of information, the contradiction between supply and demand of radio spectrum resources become increasingly acute, normal operation of various types of radio business is facing great challenges, rely on a single mode of administrative examination and approval of the radio spectrum resource configuration already can not adapt to the current situation. Therefore, we need to study the usufruct of radio spectrum resources acquisition and exercise, so as to achieve the optimal allocation of radio spectrum resources. This paper is based on the state ownership of the property law, identify related concepts of radio spectrum resources, pinpoint the legal nature of the radio spectrum resources, meanwhile, according to the characteristics of the real right object, offer a proposal to establish and improve the system of usufruct of radio spectrum resources in China.
