As a new form of education, homeschooling originated from the end of the 19th century in the United States. It is quite different from traditional school education. Homeschooling has been spread to many other countries and regions with its unique vitality. Nowadays, with the development of the whole society and the awakening of individual consciousness, as well as the appearing of drawbacks in traditional education, homeschooling is blooming in China. Since homeschooling can make up for some shortcomings of school education and promote the development of individual personalization, it is attracting more and more followers and practitioners. Considering that homeschooling is in the exploratory stage in China, we need give admission to it on the basis of comprehensive understanding. During this process, the most critical step is to prove the legal identity of homeschooling and explore standardized development path for it. The research is trying to present the implementation status of homeschooling in China by interviewing the people who are practicing this new form of education. Then, on the basis of the combination of theory and interview materials, this research will prove both the legality and legitimacy of homeschooling and try to find some ways to solve the problems people are confronted with, to make the development of homeschooling walk towards a standardized road in China.This paper can be divided into five parts. The introductory theory expounds this research project's reason and current situation, defines some concepts, for example. "homeschooling", "legality and legitimacy", and do some introduction about research technique. The second chapter presents the implementation status of homeschooling in China based on interview materials, introducing family characteristics, faculty situation, curriculums, organization and management, as well as major difficulties. By presenting and analyzing these contents, readers will have a more comprehensive understanding about homeschooling in China, simultaneously, the major problems— —legality and standardization issues can be noticed. So the third and the fourth chapter focus on the analysis of the legality and legitimacy of homeschooling. The third chapter is based on the legal level, and the fourth chapter is based on the value level. Noticing both the legal level and value level is a creative perspective to prove the legality and legitimacy of homeschooling. The last chapter focus on how to make the development of Chinese homeschooling more standardized from the aspects of legal system, education administration system and social support systems. There is no doubt it is the inevitable pursuit after proving the legality and legitimacy of homeschooling.
