Study On Environmental Protection Law In China’s Overseas Investment

With the development of China’s economy,there are more and more overseas investment,on the one hand,overseas investment has benefited China economically,on the other hand,China’s “environmental risk theory”is also soaring.China has always adhered to the path of peaceful development and shoulder the responsibility of major powers,in foreign investment,we should not only pay attention to economic interests,but also pay attention to protecting the ecological environment of the host country when investing in foreign countries,so as to achieve common prosperity and practice the proposition of the community of common destiny,only in this way can China’s overseas investment be developed in the long run,so as to maintain in the image of China’s responsible power.As a parent country of investors,China should regulate itself in pursuit of economic interests and strive to achieve win-win results between China and the host country.From the perspective of law,politics and economy,it is justifiable to protect the ecological environment of investment by standing in the position of the motherland,at the same time,the influence of Chinese domestic law on relevant investment factors also makes it feasible to protect the ecological environment of overseas investment from China’s standpoint.At present in China is no specific the law to protect ecological environment of overseas investment,mainly exist in the administrative regulations,the relevant legal documents with the provisions of the regulation of overseas investment enterprises in China with the host country in the international investment treaties provisions for environmental protection also does not see more;Chapter four analyzes the domestic and international legal rules of China’s overseas investment environment and the defects of the system;With the rapid development of China’s overseas investment at present,the investment environmental damage from the environmental risk of more and more,and in the world pay more and more attention to environmental problems,environmental damage has become China’s overseas investment in overseas investment process.So of disputes occurred in the reality of the investment environment is analyzed,so as to show the necessity and urgency of environment protection investment destination,in the protection of the existing investment environment of legal rules is introduced and find out its shortcomings,form the perspective of China,form the level of domestic law and international law puts forward the measures for perfecting the protection of environment in China’s overseas investment.
