Research On Environmental Enforcement Of Public Security Organs

The seriousness of China’s current environmental problems and the complexity of future ecological problems determine the urgency of eradicating environmental pollution and the necessity of protecting ecological resources and environment.However,the environmental administrative law enforcement of environmental protection departments in China has long been weak in supervision,substituting punishment for management,and weak in law enforcement,which is not conducive to reversing the current situation of environmental deterioration and eradicating environmental problems.Strengthening public security environmental law enforcement is the need to effectively control and deal with severe environmental problems,and is the general trend.Taking S city as an example,this paper makes a systematic and comprehensive analysis of the existing problems,finds out the main problems and causes of the problems,and puts forward some countermeasures and suggestions under the guidance of relevant theories and foreign practical experience.This article includes the following five parts.The first part elaborates the background and significance of the paper,summarizes the research status of public security environmental law enforcement by scholars at home and abroad,and clarifies the ideas and methods,innovations and shortcomings of the article.In the second part,the specific concepts of environmental police are explained,and some theories related to this paper are integrated.The third part introduces the current situation of S city’s public security environmental law enforcement,analyzes and points out the existing problems of S city’s public security environmental law enforcement,and points out the causes of the problems.The fourth part analyzes and draws lessons from the useful experience of foreign police environmental enforcement.The fifth part,in view of these problems,combined with the actual situation of public security environmental law enforcement in S city,puts forward countermeasures to improve the public security environmental law enforcement in S city.The sixth part summarizes this article.This paper mainly adopts case analysis method and comparison induction method.Aiming at the problems existing in the environmental law enforcement of public security in S city and combining with its actual practice,this paper puts forward some comprehensive countermeasures to improve the ability of environmental law enforcement of public security.There are two innovations in these countermeasures: one is that the limitation of prosecution for environmental crimes stipulated in the Criminal Law of China is too short;the other is that the transfer of cases between environmental protection departments and public security organs is not connected in the practice of environmental law enforcement in S city.We should establish a joint enforcement platform.The proposition of the above two countermeasures has certain academic significance for enriching and perfecting the domestic environmental law enforcement theory,and also has certain reference and reference significance for the practice of public security environmental law enforcement in China.
