| As an important region for human survival,wetland is closely related to human society and is an ecological environment with great initial productivity on the earth.Wetland has a unique ecosystem,which belongs to one of the regions with abundant and dense biological diversity in nature.It is called the kidney of the earth and the gene pool of species.Wetlands play a vital role in water conservation,flood control and drought relief,climate improvement and other aspects.China is rich in wetland resources,with a wide range of distribution and a wide variety of types,belonging to one of the countries with relatively complete types of wetlands.Over the past half century,a large number of wetlands have been transformed into farmland,and excessive exploitation and utilization of wetland resources have led to the increasingly reduced area of wetlands,the serious decline of ecological functions of wetlands and the decline of biodiversity.Although some local wetland protection regulations have been issued,the situation is not optimistic.China’s wetland resources are faced with srinking area,poor management and insufficient legislation and other problems,which need to be addressed from the legal level.Based on the actual situation of China’s wetlands and the existing problems,this paper analyzes how to protect wetland resources in foreign countries,and draws on the successful experience of foreign countries,and puts forward corresponding improvement measures from three aspects of legislation and judicial enforcement.The paper is divided into five chapters.The first chapter is the introduction,which introduces the research background,purpose and significance of the paper,the status of wetland research at home and abroad,and the research content and method of the paper.The second chapter is an overview of wetlands,introducing the meaning,classification and function of wetlands,as well as the natural condition and legislative process of wetlands in China.The third chapter is about the existing legal problems in wetland protection in China.It starts from three aspects of legislation and judicial enforcement.The fourth chapter is the enlightenment of foreign wetland protection to China,introducing the experience of other countries such as the United States,Australia and Japan and the reference significance to China;Chapter five is the suggestion of perfecting the legal protection of wetland in China.Through the combination of legislation,justice and law enforcement,a relatively scientific and systematic legal system of wetland protection is established to better protect China’s wetland resources and promote the sustainable development of China’s wetland resources. |
