Research Expert Assistant System In Environmental Givil Trial

The number of professional,modern and complex environmental civil cases has been increased.However,the existing loopholes and deficiencies exposed by the environmental judicial identification system are criticized by people,and it has been unable to meet the urgent needs of environmental civil litigation.The birth of the expert assistant system has its inevitability.Its role in environmental civil cases is self-evident,but it has many shortcomings due to its short birth time and flaws in the system.Therefore,it is particularly important to improve the system of expert supporters and to apply them widely in judicial practice.Based on the theory of the expert assistant system and after fully studying it,this paper finds the problems of the expert assistant system in the application of environmental civil cases and compares the system ’ s feature with the characteristics of foreign environmental civil cases in which experts participate.It aims to learn from foreign countries and contributes to the improvement of the expert support system in environmental civil trials in China for the purpose of facilitating the handling of environmental cases.This paper is mainly based on the core theme of “Improving the System of Expert Supporters in Environmental Civil Trials”,which is organized in chapters.In the introduction part,the background of the topic,relevant research status,research significance and research methods are clarified and rationalized,and the basic ideas of the research are put forward.The first chapter is the basic theory of expert assistant system.Through the elaboration of the concept,status quo and characteristics of the expert support system in China,the system is comprehensively understood.The second chapter is the problems of the expert assistant system.From the research on the theory of the expert assistant system,the problems of the system in the environmental civil case are analyzed,which paves the way for the improvement of the system.The third chapter is the participation of foreign experts in the investigation of environmental civil cases.Through the introduction of the expert participation system in environmental civil cases in the United States,France,Australia and Japan,and their successful experience,we find the ways suitable for the growth of the expert support system in China.The fourth chapter is the improvement of the expert assistant system in China’s environmental civil trials.According to the problems existing in the environmental civil cases of the expert assistant system,combined with the successful experience of foreign countries,this paper finally proposes a new idea to improve the expert assistant system.
