On The Construction Of Soil Pollution Control Fund System In China

Soil is an important natural resource,soil is the foundation for sustainable development of human beings.The development of economy and society not only creates huge wealth and facilitates production and life,but also brings unparalleled pressure on soil resources.The situation of soil pollution in China is increasingly serious,and the harm and consequences caused by it are also obvious.Soil pollution prevention and control is a huge project,which requires not only manpower but also material resources and a large amount of repair funds.Controlling soil pollution is difficult,progress is slow and lack of funds is an important factor.In view of the current problem of relying on the pollution responsible person or only relying on the national financial support and the huge amount of governance funds,some developed countries have given a feasible path,they have set up the soil pollution fund,to solve the fund gap,the American super fund system is a typical example.According to the international experience,the soil pollution prevention and control fund can play the role of effective financing to solve the problem of inadequate governance fund.China’s new soil pollution prevention and control law also makes clear the fund system in the form of legislation,and requires the state to increase the investment of soil pollution prevention and control funds.At present,China’s relevant work is still in the initial stage,a long way to go.In the fund raising channels,in addition to financial allocation,multichannel access to soil pollution control fund is indeed an imminent problem.In addition,for the fund’s budget management,supervision and inspection and other related work,there is no clear provisions.Therefore,in order to promote the effective implementation of the law,it is imperative to accelerate the construction of related supporting policies and specific management methods.The super fund system of the United States has achieved remarkable results in soil pollution control,and its mature legislative technology and advanced experience in fund raising have certain reference value for China’s soil pollution control.Based on the introduction of American super fund law and the analysis of its experience and deficiencies,diversified and market-oriented fund raising channels can effectively alleviate the shortage of fund sources for soil pollution prevention and control.At the same time,only by clarifying the scope and conditions of use of the fund,strengthening the supervision and management of the fund andstipulating relevant legal responsibilities can efficient soil pollution remediation work be guaranteed.This paper constructs a soil pollution prevention and control of fund management institution with Chinese characteristics suitable for China’s national conditions.
