Research On Legal Issues Of Commodity Packaging Under The Principle Of Circular Economy

The sustainable development strategy has become a global trend,and source control and commodity life cycle governance have gradually become mainstream.Developing a circular economy and creating a conservation-minded society is an inevitable choice for current social development,and it is also a major strategic decision in China.In recent years,the application of Internet technology stimulated the rapid development of the e-commerce economy,and also brought a lot of vitality to the new industries such as express delivery and takeaway.In addition,the improvement of living standards,the growth of spending power and the transformation of consumption patterns have also brought a series of new problems;among them,the waste of resources and environmental pollution caused by commodity packaging are the most important and urgent problems.Regarding the development of circular economy and the regulation of commodity packaging following the principles of circular economy,foreign countries started early and are constantly maturing and improving,and have accumulated many excellent experiences.This article analyzes laws and regulations related to commodity packaging at home and abroad,summarizes advanced foreign countries,and combines with China's national conditions and legislative status,trying to provide useful reference for the legislation of China's commodity packaging and the good development of circular economy.This article is divided into five parts.The first part is the introduction.This section narrates the various problems brought about by commodity packaging.By comparing and analyzing domestic and international legislations and combining with the current development trend of society and the world,it expounds the significance of researching and improving China's commodity packaging legislation.The second part is the introduction of the basic theory of circular economy.This section points out the necessity of implementing the producer extension system.The third part is related to foreign legislation and experience.This section lists the legislation,systems and policies of the Germany and Japan in the field of commodity packaging and waste recycling.By analyzing their operating modes and recycling systems,conclude that they have perfected the legal system based on the principle of circular economy.Their legislation system is perfect,the main body of the obligation is clear,the operation regulations are detailed,and the safeguard measures are strong.The fourth part is the current status and deficiencies of China's relevant legislation.This part lists and analyzes China's relevant legislation and policies,and concludes that although China has also implemented an extended producer responsibility system and is working hard to develop a circular economy,the legislation is not perfect and the system has not yet been formed;the regulation is lacking Insufficient strength;the distribution of obligations among the various subjects is slightly uneven,and a closed-loop restriction relationship cannot be formed;the guarantee measures are slightly weak,and need to be strengthened and perfected.The fifth part is the suggestion to perfect the relevant legislation of our country.This section puts forward suggestions to improve the legislation of China's commodity packaging from various aspects such as legislation,system,industry,publicity and education.
