Research On The Supervision System Of Environmental Protection In China

Environmental protection supervision system is an important means to solve environmental problems in China at the present stage.It is generated when the overall environmental pollution situation of the country cannot be effectively controlled,major environmental problems cannot be effectively solved,and conventional bureaucratic environmental protection management cannot effectively cope with the increasingly severe environmental pollution situation.The essence of the environmental protection supervision system is to enable local party and government departments to actively fulfill their environmental protection responsibilities,supervise them to administer according to law,implement their environmental protection responsibilities,and promote the effective implementation of national environmental protection laws and policies throughout the country.As the environmental protection violation cases and using environmental protection supervision system of fierce debate among academics,research on the basis of the theory of administrative supervision,source governance theory,policy theory,using the method of literature research,case analysis and empirical research methods,from the related theory problems of environmental protection supervision system,further analysis of the problems existing in the environmental protection supervision system in China,hoping to help improve environmental protection supervision system in China.According to the analysis of the relevant theoretical problems of the environmental protection supervision system,there are two kinds of environmental protection supervision.One is the inspector who emphasizes the investigation of environmental violation cases.The former conforms to the theory of environmental protection source management and is the core of the environmental protection supervision system,while the latter belongs to the post-enforcement supervision and is the general content of the environmental protection supervision system.It is further believed that the core of China’s environmental protection supervision system should be the prior supervision in line with the theory of environmental protection source management,rather than the current emphasis on the investigation of environmental violations.This paper analyzes the current situation of China’s environmental protection supervision system,and points out that the guiding ideology of China’s environmental protection supervision system fails to fully reflect the particularity of environmental protection supervision system,the system of environmental protection supervision system needs to be improved,the content of the system of environmental protection supervision system is not perfect,and the supervision object of the system still needs to be improved.This paper analyzes the causes of the problems in China’s environmental protection supervision system,and points out that the causes of these problems lie in the ideological constraints,the lagging development of the national environmental protection supervision system,and the impact of the social transformation period.Aiming at the problem of environmental protection supervision system and causes of reference of foreign experience in supervision system,the guiding principle of further perfecting the system of environmental protection supervision,perfect the system of environmental protection supervision legal system,build system of public participation,suggested that the environmental protection supervision to develop in the direction of environmental protection law enforcement examination system,to perfect the system of environmental protection supervision in our country.
