| BackgroundMedical institutions,which undertake the numbers of tasks such as healing and curing patients and diseases prevention.play an important role in China’s health system,as well as an important part of state health undertakings.Their actions are relevant to the public health and safety,even people’s lives.Therefor,the practices of medical institutions must be under the law.Illegal practices of medical institutions and their stuffs are harmful to the development of the health undertakings,by bringing tons of damage to the patients,disturbing the order of medicine and making the relationship between doctors and patients tense.The punishments,which are made during the process of health administrative law enforcement,can efficiently stem or hit illegal behavior.Thus as,administrative punishments maintain the medical circumstance,so that promote the development of China’s health undertakings.ObjectivesBy analysis of the files of administrative penalties for the medical and health supervision specialty in Jinan Health and Family Planning Supervision Institute from 2011 to 2015,I discusses the types,causes,penalties and services of medical and health illegal behaviors,and provide the basis and reference for the revision of relevant legal provisions and health supervision work.MethodsSources1 784 files of administrative punishment of medical and health supervision specialty published by Jinan Health and Family Planning Supervision Institute from 2011 to 2015.2 Statistics of Jinan’s national economic and social development published by the website of Jinan Statistical Bureau Data.3 Statistical data of medical and health resources in Jinan City published by Jinan Health and Family Planning Commission website.4 Statistical data of human resources of health supervision in Jinan City inquired from Health Supervision Center.Research methodsThe data is recorded by Excel,and analyzed by Excel and SPSS 19.0.Results1 The number of medical institutions in Jinan exceeds the national guideline,and the number of private hospitals has increased greatly.However,there is a big gap between the human resources indicators of health supervision and the national standards.2 The number of cases investigated each year is generally decreasing.Among the medical institutions punished by administration,hospitals accounted for the largest proportion,77.17%;among all the hospitals punished,first-class hospitals accounted for the highest proportion.40.83%;among the medical institutions with different ownership,private forms accounted for 58.02%;among different business nature,for-profit medical institutions accounted for 84.13%.3 Illegal cases involved in many aspects,illegal advertising propaganda accounted for the largest proportion,42.09%,the use of non-health technical personnel engaged in health technology work accounted for 22.07%.4 51.79%of the offenders were fined administrative penalties,the average amount of fines was 3741 yuan;49.62%of the offenders were warned of punishment.97.70%of the administrative penalty decisions shall be delivered directly.Summary procedures penalized 380.accounting for 48.47%.5 There are obvious differences in the number of cases investigated and dealt with in different administrative regions,accounting for 96.29%of the total cases in the five districts of Lixia,Shizhong,Huaiyin,Tianqiao and Licheng.The number of medical and health supervision cases was negatively correlated with the total number of hospitals,the number of tertiary hospitals,secondary hospitals,the number of primary medical and health institutions,the number of beds,the number of health technicians,the age and educational background of health supervision personnel,and positively correlated with the number of health supervisors.Countermeasures and suggestions1 We will increase the strength of health supervision in Jinan,increase the staffing of health supervision institutions and the number of professionals,formulate standards and conditions for the admission of health supervision personnel to meet the actual needs,and enhance the ability of supervision and law enforcement.2 Hospitals,especially first class hospitals and private hospitals,should be the focus of supervision.3 Strengthening publicity of the rule of law and improving the consciousness of law-abiding in medical institutions and their personnel.4 We should strengthen joint efforts among different departments to innovate the means of health supervision and law enforcement.5 Amend relevant laws and regulations.and increase punishments.6 Promote the flow and sharing of medical resources. |
