| With the strong support of the country,the number of Chinese medicine patents in my country has grown rapidly in recent years,but it has yet to show a qualitative leap.A large number of low-quality patents not only cannot effectively protect traditional Chinese medicine,but also affect the patent examination cycle,waste limited examination resources,and are not conducive to the transformation and utilization of traditional Chinese medicine scientific and technological achievements.Therefore,improving the quality of traditional Chinese medicine patents and striving to promote the creation of more high-quality patents with high technological content and good market benefits by innovation bodies are important ways to strengthen the protection and application of intellectual property rights in traditional Chinese medicine.As an important carrier of traditional Chinese medicine,Chinese patent medicine has gradually gained people’s favor because of its advantages such as convenience in taking and determination of efficacy.In particular,Chinese patent medicines for Class A medical insurance are widely used in my country,with more in-depth research and considerable patents.This study takes class A medical insurance proprietary Chinese medicines as an example to build a high-value patent evaluation index system that meets the characteristics of traditional Chinese medicine patents,and aims to provide a method for digging out high-value traditional Chinese medicine patents from a large group of traditional Chinese medicine patents.Value patent search efficiency,guide and promote the improvement of Chinese medicine patent quality and patent application.1 Data sourceThe data of Class A Medicare Patented Medicines comes from the incopat database.The name of Class A Medicare Patented Medicines is searched globally.The patent period starts and ends from April 1985 to November 2019.After screening according to the inclusion and exclusion criteria,Obtained 3528 patents.2 Research methods and content2.1 Propose preliminary evaluation dimensions and evaluation indicatorsIn order to deeply understand the characteristics of Chinese medicine patents,the data samples of Chinese medicine patents in the 15th to 18th Chinese patent awards and patent patents of Chinese patent obtained based on incopat database were analyzed by content analysis method,key description items of Chinese medicine were extracted,general principles and consensus of high-value patent evaluation were combined,and preliminary patent evaluation in line with the characteristics of Chinese medicine was proposed Price dimensions and indicators.2.2 Determination of patent evaluation indicators,weights and scoring standardsUse the expert consultation method,questionnaire survey method and Likert five-level scale method to determine the dimensions and specific indicators of the patent evaluation indicators,conduct consistency checks,and determine the weights.Through the method of holding an expert seminar,the Chinese medicine high-value patent scoring standard is determined.2.3 Empirical research and verification of evaluation index systemThe combination of low-value patents derived from the patent evaluation index system of Hexiang,Zhiya and Hengcheng Zhidao Company was used as the low-value patent inspection sample,and the Chinese medicine patents in the 19th to 21st China Patent Awards For high-value patent inspection samples,calculate the accuracy and recall rate of the evaluation index system proposed by this institute.3 Research results3.1 Preliminary construction of 4 evaluation dimensions and 64 evaluation indicators that meet the characteristics of traditional Chinese medicine patentsThe 39 Chinese medicine patents that won the Chinese Patent Award are all invention patents,which have been authorized and valid.In addition,the common points of most patents include:the maintenance period exceeds 16 years,the applicant type is an enterprise,the number of claims is more than 6,the economic benefit conversion has occurred,the number of IPC classification numbers is more than 6,the number of key description items in the patent specification More than 6.Nearly half of the patents have in common:the patent cites other documents and there are no comparison documents.A total of 36 key description items related to traditional Chinese medicine were extracted by reading the original text of the winning patent.There are a total of 3528 patents on patent medicines for Class A medical insurance.Through analysis,it is found that in addition to the above indicators,the number of applicants and the number of patent literature pages can also show the gap between patents for patent medicines for Class A medical insurance.By reading the original text,49 Key description itemsConsidering the characteristics of the award-winning patents and patented Chinese patent medicines comprehensively,four evaluation dimensions,were proposed:the law,technology,market and content for evaluating high-value patents of traditional Chinese medicine.Among them,the legal dimension includes 4 indicators such as patent maintenance years,the technical dimension includes 6 indicators such as the number of patent citations,the market dimension includes 5 indicators such as patent transfer status,and the content dimension includes 49 evaluation indicators such as extraction methods,for a total of 64 Evaluation indicators3.2 Screening and determining 46 Chinese medicine high-value patent evaluation indexes and weightsDesigned and issued the "Chinese Medicine High Value Patent Evaluation Index System Expert Consultation Questionnaire" and "Content Dimension Index Selection Expert Consultation Questionnaire".After expert screening,the Chinese medicine high value patent evaluation index system was determined by the legal dimension,market dimension,technical dimension and content Dimensional composition,including 46 evaluation indicators,including patent maintenance time,number of claims,patent types,authorized patent invalidation reasons,a total of 4 legal dimension indicators,number of patents of the same family,patent litigation status,patent transfer status,patent licensing status,patents The pledged state has a total of 5 market dimension indicators,including the number of citations,specification pages,the number of classification numbers,the number of common applicants,the number of cited documents,and the number of comparison documents.There are 6 technical dimension indicators,solutions,traits,extraction methods,and efficacy.,Processing technology,quality control methods,etiology and pathogenesis,drug contraindications,inclusion exclusion criteria and other 31 content dimension indicators,and passed the consistency test.3.3 Empirical research and verification results of Chinese medicine high-value patent evaluation index systemThe combination of low-value patents derived from the patent evaluation index system of Hexiang,Zhiya and Hengcheng Zhidao Company was used as the low-value patent inspection sample,with a total of 67 items.Taking 37 traditional Chinese medicine patents from the 19th to 21 st China Patent Awards as high-value patent inspection samples,calculated according to the formula of accuracy and recall rate,the calculation result is the accuracy of the evaluation index system proposed by the Institute The rate is 91.3%and the recall rate is 100%.It is preliminarily believed that the TCM high-value patent evaluation index system has passed the verification4 Conclusion and discussionAt present,the research object of the high-value patent evaluation index system at home and abroad is all patents,and no classification research has been carried out,and the results produced by each evaluation system are quite different.This research aims to build a high-value patent evaluation index system that conforms to the characteristics of traditional Chinese medicine.It takes class A medical insurance proprietary Chinese medicine as an example to conduct a study.It fully investigates the existing commercial patent evaluation system.In addition to the legal dimension,market dimension and technical dimension indicators,the content dimension indicator is also considered,which reflects the content characteristics of the Chinese medicine patent itself,and the weight and scoring criteria of each indicator are clarified,and consistency and empirical verification are carried out,A preliminary evaluation index system for high value patents of traditional Chinese medicine has been established.The process of this study follows the principles of scientificalness and operability At present,the application of high-value
