| Although the Jin Dynasty was a minority regime established by Jurchen in the north of Jina,the law was deeply influenced by Tang Law.The study of the Central Plains legal system in the Jin Dynasty is not completely copied,and the system of "delisting" in the Jin Dynasty should be inherited and developed in addition to the relevant system in the Tang Dynasty,and also have its own characteristics.In addition to the introduction and conclusion of the main part of this thesis,it is divided into three chapters:The introduction part mainly introduces the purpose and significance of this paper,combs the previous research results in this field,summarizes the shortcomings of the current research,and introduces the research ideas and methods,innovation points and difficulties and the definition of related concepts.Chapter one: trace the historical origin of the system of "de-listing" of Jin Dynasty,and discuss the beginning time of "de-listing" of Jin Dynasty again."De-listing" has been produced as early as the pre-Qin period,and continued for the dynasties.There is no record of "de-listing law" in the customary law of the Jin Dynasty itself,and the "delisting" system of the Jin Dynasty is obviously imitated from the relevant system of the Tang and Song dynasties.Previous scholars believe that the "delisting" system of the Jin Dynasty should first appear in the Tianhui four years,but the author found through textual research that the "delisting" of the Jin Dynasty should actually appear in the Tianhui ten years at the earliest.Chapter two: analysis of the implementation of the "de-listing" system,including the criminal charges applicable to "de-listing ",the rank of " de-listing " officials," deathfree de-listing" and "de-listing" officials of the recounts.This chapter considers that the rank of "delisted" officials in the Jin Dynasty is extremely broad,not only senior officials will be "delisted ",low-level officials,personnel without official rank have serious crimes,will also be " delisted ".A total of 21 cases of "de-listing" of low-level officials and persons without official rank,although accounting for only nearly a fifth of the total number of "de-listing" of the Jin Dynasty,can still be explained that the Jin Dynasty against low-level officials,no official rank of serious crimes,is still severely punished.There were 13 cases of "death-free delisting" in the Jin Dynasty,of which 10 were Jurchen,indicating that "death-free delisting" became a tool to protect Jurchen from crime.After the Jin Dynasty officials were "removed ",there will be a chance to recount.Although the rulers of the Jin Dynasty insisted on the equality of all ethnic groups in employing people,the distrust of the officials of the Jin Dynasty was deeply rooted.The third chapter summarizes the characteristics of the system of "delisting" in the Jin Dynasty and its influence on later generations.First of all,the Jin Dynasty’s "delisting" of various types of charges in the reign of different emperors constitute a different proportion.From Jin Xizong to Jin Shizong,the number of cases of "delisting" due to political crimes accounts for a large proportion,indicating that the Jin Dynasty needs to maintain the stability and political stability of the throne through "delisting ";when Jin Shizong,the largest proportion of official duty crimes was " delisting ",indicating that Jin Shizong took "delisting" as an important means of rectifying the administration of officials;Wei Shaowang began to "delisting" officials due to military crimes,indicating that the late Jin Dynasty war,the need to "delisting" military crimes "to rectify the military discipline ".Second,the Jin Dynasty’s "delisting" system in the early implementation of more stringent,in the later period due to frequent war collapse.Third,the Yuan Dynasty inherited the Jin Dynasty’s "delisting" system.However,the Yuan Dynasty’s "delisting" is rarely used to punish officials for political crimes.In addition,the punishment of "rape crime" has been increased,indicating that the Yuan Dynasty took the life style of officials as an important content of assessing officials.The system of "de-listing" was continued in the Ming and Qing dynasties.Conclusion: This paper summarizes the previous research and evaluates the system of "delisting" in Jin Dynasty.The implementation of the system of "de-listing" of the Jin Dynasty has obvious stage characteristics,and has indeed played the role of rectifying the administration of officials and punishing officials for crimes in a certain period of time.However,the emergence of many cases of "delisting" in the late Jin Dynasty shows that the delisting system has completely lost the role of deterring officials from committing crimes,which has become the epitome of the collapse of the criminal punishment system of officials in the Jin Dynasty. |
