Research On Social Forces Participating In Community Correcrtion

As an important part of the government's social management,community correction is a new means of execution punishment and an innovation of social management system.The ultimate goal of community correction is letting the prisoners integrating into society,with the characteristics of execution socialization.This feature determines that judicial administrative organs must effectively integrate various social forces into community correction.How to utilize various social resources actively,how to integrate all aspects of society force and participate in community correction actively and effectively,which is the research that needs to be studied deeply at present.In domestic and international practice,the participation of social forces has been widespread,the Ngo,social workers,volunteers are numerous in Japan,United States and other countries,while the social forces participating in community correction in our country starts late.In Beijing,Shanghai,Zhejiang and other developed areas,voluntary organizations,volunteers,professional social workers appear participate in the community correction.From the present of community correction in practice,the participation of social forces is in a low degree,in addition to the function of regulation,the supporting education effect is not obvious.Under the theory basis of community correction law,recoverable judicature,new public management theories,this paper analyzes the present of social forces in community correction in Licheng,on the basis of visiting researches,questionnaire investigation and individual interview,according to collecting first-hand information.According to the paper,the participation of social forces is limited,large-mobile and strong-administrative.The reasons are two,the deep affection of tradition of Laws and newly sprouted things of community correction.At present,people have long time to accept it,current laws and regulations are imperfect,and all kinds of social forces do not develop to the requirement phase of the community correction.Using comparison method,this paper analyses advanced experiences of Japan,the United States and other countries and worthy practices in Beijing,Shanghai and other places,and further summarizes the necessary condition of social forces to participate in correction.Therewith,this paper aims to point out the reasonable and feasible suggestions and measures for the participation of social forces in community correction,from the aspects of strengthening publicity,improving the legal system,fostering multi-party social forces,establishing one-stop service center,government purchasing remedial service,clarifying the division of labor between government and society.Hope that through the systematic and theoretical thinking of participation of social forces in community correction,this paper is able to provide referential experiences of social forces participation in Licheng and other similar urban-rural fringe regions.
