Now mankind is entering the era of artificial intelligence from the Internet age.The rapid development of artificial intelligence has had a profound impact on human social life.Smart cars,smart homes,smart medical care,and smart cities all reflect the dividends the artificial intelligence technology brings.The tentacles of artificial intelligence have also penetrated into the realm of justice.The "smart court" is the best example of the deep integration of artificial intelligence and judicial trials.Driven by the supreme people's court,China' s smart court construction is still in its ascendant.Based on the development of speech recognition,image recognition,cloud computing,and deep learning technology,and the improvement of judicial big data,the People' s Court and artificial intelligence companies have worked closely together to combine the reformation of the judicial system and the application of modern science and technology.They developed all kinds of artificial intelligence platforms such as speech intelligent identification system,intelligent legal retrieval system,intelligent trial supporting system,etc.In the aspect of achieving fairness and justice,improving trial quality,and preventing judicial corruption and improving the level of litigation services,these platforms have their own value and unique advantages,which have also become the main driving force for artificial intelligence technology to play a role in the construction of wisdom courts.However,we must realize that the smart court construction is a systematic project,and the further integration of artificial intelligence and judicial trials is also facing many challenges and risks,which require comprehensive assessment and active response.This article consists of four parts:The first part is an overview of the smart court.This section firstly introduces the background of building smart courts,including the development status of artificial intelligence and the historical evolution of artificial intelligence intervention in judicial trials.Then it systematically introduces the concept and construction goals of the wisdom court in the era of artificial intelligence,and further clarifies the position of artificial intelligence in the smart court-that is assisting the judge in handling the case.The second part is the application of artificial intelligence in the smart court.On the one hand,from the perspective of artificial intelligence servicing judicial trial,it introduces the application scenarios of intelligent speech recognition,legal search and case push,and intelligent trial assistance system.On the other hand,from the perspective of artificial intelligence servicing litigants,it introduces the electronic litigation application scenario represented by Chongqing online intelligent court and Beijing "palm smart court".The third part is the value of artificial intelligence in the smart court construction.This part starts with the application of artificial intelligence in the wisdom court,and systematically analyzes the value of artificial intelligence in the smart court construction,including five aspects of enhancing judicial efficiency,dwindling the judicial gap,preventing wrong cases,preventing judicial corruption,and promoting fairness and justice.The fourth part is the challenge of the smart court construction in the era of artificial intelligence.The main challenges of smart court construction include rejection and question judicial artificial intelligence faces,shortage of compound talents,weak judicial big data,increased risk of personal data leakage of participants in the proceeding.The fifth part is the countermeasures of promoting China's smart court construction.Based on the challenges of smart court construction,it puts forward the countermeasures,including to overcome the fear of the judicial artificial intelligence,cultivate compound talents,improve the judicial big data,increase the protection of personal data of litigants.
