Evidence Issue Of Match-Fixing In Court Of Arbitration For Sport's Cases

The panels9 decisions of the Match fixing cases which has been committed to explain and criticize the sports legal norm without any misleading label.The study of Match fixing as the the important type of arbitration for sport,however is carried out very late,and relevant study is less.The evidence rules' function is to discover the case facts,identify and maintain the important value of due process,so the explore this project is an essential part of legal law study.All of the study we do is based on basic theory research,this article does not attempt to study all the evidence issues in the case of Match fixing,but selectively summarize those evidence issues which I am really interested in.For example,the 'exclusionary rules of illegal evidence' are not not enforceable,the tolerant attitude towards scientific evidence,which mainly discuss about Betting Fraud Detection System,and the problems of the reverse of burden of proof when club faced Match fixing.Meanwhile we also need to solve those problems when CAS accept illegal evidence,how to balance the interests of the athletes and the goal of fight against Match fixing;When accept some scientific evidence,because of the sports arbitration fuzziness and elasticity,how to build a reasonable scientific evidence mechanism and so on.After studying the existing related cases and comments,we can draw the conclusion that all of the above approach have sufficient justification,and the paper puts forward corresponding adjustment thinking.This paper does some designing and regulating for the'exclusionary rules of illegal evidence',emphasize the "scientific" substantive control of scientific evidence,illustrates the importance of reinforcing evidence rules of scientific evidence,build a open system for scientific evidence,and identified the legal basis for the the principle of the reverse of burden of proof.
