Research On Online Arbitration Of Internet Financial Dispute

In the face of increasing Internet financial disputes,traditional dispute resolution mechanisms,such as litigation,on-site reception,mediation,and complaint acceptance by regulatory authorities,have many problems,such as high cost,time-consuming,difficult start-up and lack of professionalism,which gradually show various incompatibilities in dealing with disputes.In order to build a dispute resolution mechanism for interconnected financial disputes,we must fully take into account the characteristics of Internet financial disputes,with its network,large number,involving many,wide geographical areas as the main consideration.On this basis,combined with the Internet financial dispute resolution needs,low cost,high efficiency,convenience,professionalism,privacy,in order to establish a suitable dispute resolution approach.After analyzing the characteristics and requirements of Internet financial disputes,this paper examines the dispute resolution mechanism of online arbitration,and holds that they are applicable in application.Then,the current situation and shortcomings of the existing online arbitration settlement mechanism in China are analyzed,and under the guidance of the value of online arbitration,specific suggestions for improvement are put forward.In addition to the introduction and conclusion,the main body of this paper consists of four parts:The first part is the adaptation analysis of Internet financial disputes and online arbitration settlement mechanism.This paper analyses the characteristics of Internet financial disputes,the need for dispute resolution,the limitations of traditional solutions and the advantages of the online arbitration settlement mechanism,which lays the foundation for the following elaboration.The second part is about the current situation of Internet financial dispute online arbitration settlement mechanism.The current situation part mainly introduces the development status of online arbitration from three aspects:the legal basis,the existing operation mode and the operation process.The third part is the insufficiency of the Internet financial dispute online arbitration settlement mechanism.Starting from the current situation of the online arbitration settlement mechanism,combined with the practical operation and judicial confirmation,this paper clearly points out the shortcomings in the operation of the online arbitration.The fourth part is the suggestions to improve the Internet financial dispute online arbitration settlement mechanism.This part analyses the deficiencies of the third part,and puts forward the corresponding solutions based on the value analysis and the suggestions of experts and scholars.
