Research On The Relevant Terrorist-related Clauses In The Amendment To The Criminal Law(Nine)

In 1960,terrorism began to appear,its bloody violence not only seriously endangered people's lives and property security,but also affected people's hearts,resulting in psychological panic,and then affected social life and productive activities.Since 9 / 11,terrorist activities have intensified all over the world.To this day,not only typical cases of female terrorism(such as the Black Widow in Chechnya),but also appalling terrorist groups such as the Islamic State have emerged.Nowadays,terrorism has not disappeared,but has become rampant,threatening the stability of political regimes and the safety of the lives and property of the masses of all countries.2 Since 013,the number of violent terrorist incidents in China has been on the rise,the number of terrorists has increased,and the social order and the people's property of our country have been seriously threatened and challenged.The crime of terrorist activities is a serious criminal offence,and the society is very harmful.So far,the relevant provisions related to terrorism in our country are also increasing.Now,in addition to the criminal law,there has also been a special anti-terrorism law with the characteristics of administrative law to deal with terrorism.Because of the particularity of terrorist crime,we may face unpredictable problems and challenges in the process of cracking down and governance,which need to be dealt with flexibly.The legislation is lagging behind.Although many provisions on terrorist crimes have been added to the Amendment(9)to the Criminal Law,which began in 2015,there are still unreasonable allocation of penalties,lack of some charges and unclear concepts.Lack of prevention and other problems.Compared with the western developed countries,the criminal law on combating terrorist crime in our country started late,so we still need to carry on the in-depth study,for example,is terrorism a kind of idea or an act? How should terrorist organizations be defined,etc.?These are questions worth pondering.Therefore,we need to solve the cancer of terrorism,we need to constantly innovate,constantly take the new situation as the starting point,to observe and study the problem of terrorism,which is conducive to solving the negative impact of terrorism on society.This paper starts with the relevant terrorism-related provisions of the Amendment(9)of the Criminal Law,which is divided into four parts.The first part is about the revision of the Criminal Law.The contents and characteristics of the terrorism-related provisions are expounded,and the second part discusses the problems existing in the terrorism-related provisions of the Criminal Law Amendment(9).The third part explains the necessity of perfecting the terrorism-related provisions of the Criminal Law Amendment(9),and the fourth part puts forward some suggestions for the improvement of the terrorism-related provisions of the Criminal Law Amendment(9).This article carries on thethorough discussion and the research from these four aspects,in order to obtain the better judicial practice.
