| The supervision of postal items is an important part of law enforcement in customs.Because of the close relationship between postal articles and personal interests,the effect of the relevant law enforcement has been widely concerned by the public.The core of customs supervision upon postal articles is the "reasonable quantity" system;the"reasonable quantity" is the basis for customs to identify the nature of postal articles and the main legal basis for diverting and guiding postal articles into different modes of supervision,providing strong support for customs to regulate the order of customs clearance of im&ex articles,stabilize customs revenue and combat illegal smuggling activities.But in the actual law enforcement in customs,there are still some practical problems in the determination of "reasonable quantity" of postal articles,such as unsound rules,unscientific standards,unclear administrative discretion and inadequate regulation of administrative discretion.Starting with the introduction of the "reasonable quantity"system of customs supervision over postal articles,this paper makes a detailed analysis of the problems existing in the "reasonable quantity" system,offers legal reflection on the exercise of administrative discretionary power by customs in the process of regulation on determining the "reasonable quantity" from various perspectives,and finally puts forward some suggestions on scientific legislation over the supervision of postal articles,reasonable setting of rules and indicators,establishing norms for the use of administrative discretion,and building a supervision system for public participation.Also,the author hopes to provide some thoughts and references for the customs to further improve the relevant legal system,strengthen and standardize the actual supervision work,promote the supervision system to be more scientific and reasonable,and highly unify the expected effect of legislation and the social effect of law enforcement. |
