Research On The Reform Of Administrative License System From The Perspective Of Functional Transformation Of Government

In contemporary society,administrative license is the main means of allocation of resources for the government.Under the background of the reform of economy system in China,the economic management function of the government is constantly changing,which requires the government,market and society to be repositioned.Therefore,it is necessary to carry on the corresponding reform of the administrative license system from the perspective of the perspective of functional transformation of government.In recent years,there are decentralization,cancellation and decentralization about a large number of administrative license matters for the government.Besides,powerful examination,approval methods and approval process have been reformed and achieved remarkable results.However,due to the reasons of particularity of legislation mode and benefit game between government power and subject rights of market,and whether the legislative level or practice level,there are still many problems in the administrative license system,which needs to further promote the reform of the administrative license system and put forward the corresponding countermeasures to solve these problems.The reform of administrative license system from the perspective of functional transformation of government is hot issue of dealing with the interactive relationship between government and market properly.This paper attempts to analyze the reform difficulties of administrative license system in our country at present and put forward some countermeasures to promote the reform of administrative license system from the perspective of functional transformation of government through the study of the reform of the administrative license system comprehensively.This paper mainly discusses the administrative license system reform from the perspective of functional transformation of government from three parts.The first part explains the definition of functional transformation of government and the reform of administrative license system.The second part discusses the problems and reasons of the administrative license system from the perspectives of the functional transformation of the government.It includes: the problems of the legislation of administrative license system: the lack of maneuverability in laws and regulations;unreasonableness of administrative license setting scope and the lack of appraisal for administrative license system and so on;the problems of implementation of the administrative license system: the formalism,the improper use of discretionary power,the difficulties to ban the power rent-seeking,paying attention to licensing under the poor government regulation and so on.The causes of these problems mainly include the particularity of the legislative model,the game between the government power and the subject rights of the market,and the limitations of legislative technology.The third part is to introduce the reform experience of Zhejiang province from the perspective of the transformation of government functions,including " power lists" and " at most run for once ",the part is to introduce the influence of Zhejiang experience on the reform of the basic administrative licensing system,mainly from the following perspectives of implementation: strengthening the concept of service-oriented government,restricting the right of discretionary power,eliminating the space of renting or seeking of the power,etc.In addition,combining with my working experiences,this paper will submit opinions on the rational configuration of the subject,the perfection of the hearing system and the licensing evaluation system.
