A Discussion On Perfection Of Different Kinds Of Freedom Punishment In China

There is no clear regulation on how to punish different types of free punishment for a long period of time in China's criminal law,leading to controversy on the issue.How should we deal with such problems when different free penalties are imposed?On the other hand,in the judicial practice,there will be such a case of need and punishment.Therefore,when this problem is encountered,different penal principles and different standards are adopted.Under this circumstance,the principle of how to impose different punishments on different types of free punishment in our country were defined.The handling of this issue in China's Criminal Law Amendment(IX)is clearly defined.However,in accordance with the provisions of this article to deal with problems in practice,we will find that its shortcomings need to be improved.Therefore,i puts forward my own views on how the problem should be perfected by analyzing the pros and cons of various penalties and the experience of foreign legislation.This article is divided into five parts.The first part is the introduction part,which mainly expounds the purpose and significance of the topic selection,domestic and foreign research review and main research methods.The second part mainly introduces the present situation and existing problems of the principle of different types of free punishment in China.The third part expounds the theoretical basis and the value goal that each doctrine is based on,and compares the advantages and disadvantages of each doctrine on the basis of this.The fourth part is mainly about the investigation and evaluation of the legislative cases of extraterritorial alienation and punishment and some inspiration and worthy of reference from China.The fifth part puts forward the idea of proposing how to improve the punishment of different kinds of free punishment in China.
