Research On The Infringement Of Webcast Performance

With the development of network technology and the rise of broadcast industry webcast infringed the copyright problem is increasingly common,Law is the criterion of adjusting social life and civil behavior.The lag of law brings many problems to copyright protection in network environment.The copyright law is heavily influenced by technology,As a new technology,network broadcast has blurred the bound ary of the proprietary rights of copyright and brought many disputes to the identification of copyright infringement in network broadcast.This paper focuses on the infringement identification of network broadcast performance.Firstly,it classifies and gene ralizes the ways of infringement,secondly,it analyzes the types of exclusive rights that infringement may infringe,and thirdly,it puts forward Suggestions to amend the copyright law,such as to redefine the right of information network transmission.In addition,this paper analyzes the reasons why network broadcast performance is not a reasonable use with the three-step test method.Finally,it discusses the impact of different forms of cooperation on infringement liability.Different forms of cooperation refer to the legal relationship between performers and online platforms,which can be divided into three types: ordinary cooperation,labor contract and labor dispatch.The network broadcast platform as a technology provider is indirect infringement responsibility,when it as a content provider may direct infringement liability.
