Research On The Construction Of Smart Court Driven By Big Data

The impact of big data has penetrated into every aspect of life and work,and its value has been continuously explored and received great attention and recognition from business,government and academia.In 2015,China issued a document promoting the development of big data,marking the determination of China to build a “data power”.The advantages of big data who has low-cost and high-value have become very obvious.When big data penetrates into every field of society,it is necessary to improve the ability of each other by means of its advantages.It is also inevitable to do.The new round of judicial reform with "judicial power as the core" is in full swing at all levels of courts across the country.In the era of big data,the courts must actively take advantage of the strengths of next-generation technologies such as big data and artificial intelligence to build a “smart court” to improve service quality and optimize its own process.This dissertation adopts the ways of literature analysis,comparative analysis and empirical research.On the basis of clarifying the relationship between big data and the “smart court”,explain the feasibility and inevitability of big data-driven “smart court” construction.The “Rui Judge” system in Beijing is taken as the research object,and its construction is introduced in detail.The construction of the platform is explained in detail from three aspects: platform composition,implementation path and application effectiveness.Combined with the status quo of the construction of national courts,this paper analyzes the dilemma of the construction of "smart court" driven by big data in China,and concludes that there are five problems in the current construction of “smart court”,including the fact that the data foundation is not solid,the system construction is problematic,the demand matching is deviated,and the judicial disclosure is faced.Challenges and the specificity of the case and the relative lag of laws and regulations.This paper analyzes the causes of these problems,the lack of top-level design and planning,the imperfect big data management system,the lack of interdisciplinary talents and the neglect of the active role of judges are the causes of these problems.Finally,combined with the current construction of "smart court" in China and summed up the successful construction experiences of domestic and foreign courts,putting forward the "smart court" construction strategy driven by big data,realizing data conneceting and sharing,and participating in the scene of judicial personnel participation by improving data value.The rationality of the algorithm,the training of interdisciplinary talents,the improvement of the big data related system,and the full play of the judge's action are discussed.I hope that I can contribute to the goal of promoting the construction of the people's court informatization version 3.0.
