On The Legal Conflict And Coordination Of Free Trade Port In Guangdong,Hong Kong And Macao Bay Area

According to the report of the 19 th national congress of the communist party of China,"pilot free trade zones should be given greater autonomy to reform and explore the construction of free trade ports".At the same time,Guangdong province,as one of the important provinces is promoting the development of Hong Kong and Macao,and is closely linked to the development of the mainland.It has the advantages of convenient geographical location,developed economy and sound legislation,making it feasible and necessary to explore the construction of the free trade port in the Guangdong-Hong Kong-Macao greater bay area.Based on the reality of building a free trade port in the Guangdong-Hong Kong-Macao greater bay area,from the perspective of normative jurisprudence,it is emphasized that Guangdong province should cooperate with Hong Kong and Macao special administrative regions to explore the legal basis for building a free trade port in the Guangdong-Hong Kong-Macao greater bay area.Starting from the specific legal systems in the fields of investment management,foreign trade and financial innovation,this paper attempts to analyze and explore the legal conflicts in the construction of the free trade port in the Guangdong-Hong Kong-Macao greater bay area,and then proposes the legal coordination mechanism for the construction of the free trade port in the Guangdong-Hong Kong-Macao greater bay area from the macro and micro perspectives?This paper is mainly divided into four parts:The introduction mainly introduces the research background and significance of this paper,the research status,research methods and ideas,and makes necessary explanations on the research content and innovation of this paper.Chapter one analyzes the legal conflicts existing in the free trade ports in the Guangdong-Hong Kong-Macao greater bay area and analyzes the reasons.In order to avoid the cumbersome enumeration of legal conflicts,this paper mainly chooses three aspects to illustrate the existence of conflicts,namely investment management system,foreign trade system and financial innovation system.It provides necessary realistic support for the following discussion on the causes of existing conflicts.Chapter two analyzes the basis of free trade port cooperation in Guangdong-Hong Kong-Macao greater bay area.It mainly examines the basis of cooperation between mainland China,Hong Kong and Macao from the perspective of normative jurisprudence,and expounds the normative basis and foundation of building a free trade port from two dimensions of hard law basis and soft law basis respectively.Chapter three compares the legal conflicts and coordination situations in the construction of free trade zones outside the region so as to provide reference for the legal coordination mechanism of the construction of free trade ports in the Guangdong-Hong Kong-Macao greater bay area in China.Chapter four proposes to improve the legal coordination mechanism of Guangdong-Hong Kong-Macao greater bay area free trade port.Based on the existing legal coordination mechanism and combining the contents of chapter two and chapter three,the paper puts forward the ways to improve the legal coordination mechanism.
